According to letter 41 mph by 30 road, i do not believe it because i seen this van staying here every week once so i never go speed because i know where they are ! But almost impossible to proof it .
OH that's band B offence

4-6 points or 7-28 days ban and a fine of 100% of weekly income.

If they offer FPN or Driver Improvement (unlikely) then take it is my advice.

Fighting this could well turn out to be more expensive as 40 is the threshold for Band A or more minor speeding.

Does your vehicle have a tracker or dash cam to prove the speed is wrong?

Your first post you said mobile now you are saying fixed.

Post a streetview link to the fixed camera.
MOBILE VAN PARKED UNDER THE BLUE FIXED CAMERA and sign was 1, 1 behind.

In 2001 the law was changed so that speed cameras had to be painted yellow to ensure visibility. ... cameras must be visible from 60m away in 40mph or less zones and 100m for all other speed limit zones. signs must only be placed in areas where camera housings are located or where mobile cameras are in operation.

Yea that my understanding its a code of practice and may influence if they keep a proportion of fine revenue. But a van catches you unless you have something other than ' I know I dont drive that fast there' defence I would take the easy option now.

It doesn't matter what colour the camera was - you were caught by the van!

And - since there are no road markings, I don't believe you could ever be caught by that camera.

I think there's a little confusion here.

Op, is the camera fixed in the ground like a tradional speed camera or like the van pictures posted above? If it's the former then guidelines (note guidelines, not law) say they should be painted yellow but with mobile camera vans they can basically do what they like (some forces have plain vans, some forces have liveried vans).

Judging by what you've written, I don't think you have much of a chance getting out of it on a technicality.

Dashcam is only good if your footage isn't overwritten by the time the fine lands in this case. Ones that show speed are catch 22 as they show any indiscretions as well. I have already had a jumped up sgt claim he would sieze my dash cam to prove was going more than 30 for a moment when I refused to admit to pulling out of busy junction briskly and when I said no sd card in it as still in my computer he tried to threaten me with an attempt to pervert the course of justice charge! Charmer.

I think he's saying :

There was a mobile speed van parked under the camera, and he got caught by the van. He seems to believe that because there is a camera there - and because it's not yellow, and does not have warning signs - that somehow makes the fact that he got caught by a van invalid. Which it clearly isn't.

Especially since - as I mentioned there are no markings on the road. That speed camera clearly isn't functional - which means it doesn't matter what colour it is or what signs there are. (And even if it was functional and camouflaged, and had no signs - that is totally irrelevant when a mobile van got you).

Also the website they supply for proof of picture , its not working, when i type date, reference number and pin number they give , system says not found it !

My point is not my speed , its not police car, council not sending there, far as i know there is licence has been taken from police or council , how they can send me fine,

NO camera sign
Fixed Camera is blue according to LAW 2001 all speed cameras must be YELLOW,
Again according to law they can place only under the yellow fixed cameras or clear camera sign between FAIR distance which is NOT

So what can i do for that?

Thanks

YOU WERE NOT CAUGHT BY THE FIXED CAMERA. IT DOESN'T MATTER WHAT COLOUR IT IS.

I think we've deduced there was a mobile speed trap van parked under the (probably now deactivated) fixed speed camera.

Presumably because locals have realised the fixed camera isn't active anymore, so there are nabs to be had at that location by the speed partnership.

OP is complaining that the fixed camera isn't painted yellow, even though he says he knew it was there because he goes past it regularly.

Yes Davek more or less story like that. So as you said mobile cameras can park any where they like and start recording? So where is the law protect us even we speeding or not? Also i knew this mobile parked there everytime and never speeding this road i am %100 sure about that. But i guess cant proof it.

So anyone know who the GMPPAS? Clearly not police? Also some how if i proof they have no licence , spouse to be OFFENCE is INVALID right?

So let’s get this straight.

You’ve been caught speeding by a fixed mobile camera, not in a van parked in a lay-by. It’s not operated by the police or the council but Greater Manchester Police have sent you the NIP?

You don’t think you were speeding, because you know this camera is there, but you do drive by speed cameras at 40 in a 30 regularly.

You don’t like the colour blue and think cameras should be yellow.

I reckon you’ve got a good defence, plead not guilty and go to court with your evidence as above.

Let us know how you get on.
