Firstly C if Court faced with non attendance of offender they have the option of next step issuing a bench Warrant backed for bail or not. If backed for bail person arrested and bailed to a Court date or if not kept in Custody (generally overnight) and aligned before Court. However before they do this they have to be satisfied that Summons has come to the notice of the offender as stated above and if not satisfied another summons issued generally for a more proveable method of service.

So theoretically yes could happen person out of the Country and on return wanted on warrant of arrest for non appearance.

Records kept of person wanted for service of summons and it used to be after a couple of years in a clean out application made to bench for summons to be withdrawn as not possible to trace offender. Obviously the severity of offence may well kick in on this length of time.

That seems fair inasmuch as the the summons has to have come to the attention of the accused before arrest will follow. Presumably it's sent by recorded delivery the 2nd time, or is it by hand from a court official or a police officer?
It does seem a rather unsafe system to rely on the postal service in this way.

That is not what happened to the Aberdeen lady. She never received the Summons and in fact they were returned' unknown at this address'. She was still arrested when stopped at a random road check, so obviously you can be arrested without it being confirmed that you have received the summons.

Whilst Scottish law does not always follow that of England not privvy to the actual Court case Rayatt and what was said as to why warrant issued.
I am aware of the report in the Press but I always treat such with some sceptisism.

The case is reported quite fully on the ABD website under Humberside local issues. There are reports from several newspapers one being The Times. The facts are not disputed by the DPC or the Humberside Police. The lady was arrested because there was an outstanding warrent for her arrest and she was transported from Aberdeen to Humberside. The lady was arrested on a warrent issued by an English court.

Well got my summons the otherday..... in a hand written envolope all very smart looking....

all details inside of offence and a means test form for fine formation of repayment

I can either refute, guilty and attend or guilty and not attend ????

Hmmmmmm leaning towards guilty and not attending

Just incase anyone is interested pleaded guilty by post and resulted in £100 fine and £43 costs.....

Not bad considering... max is £1000 + costs and Reg No confiscated
