I'm a little confused now. He only took it inside after he became discovered it in his herbaceous border. I asked whether he would have become the bailee had he not discovered the wine hidden in his garden. I presume not?If the goods are left on the OP's land, he could, strictly speaking, be an involuntary bailee of the goods, but if he was unaware they were there it might be hard to prove that he failed to take reasonable care of them. Knowledge is not a pre requisite for involuntary bailment.
