RE: Trucker wins speed camera case

Nope - he doesn`t have to repeat the same journey. All he has to do is get the same distance on the tacho for the days work. Assuming that this was in an urban environment, just keep the speed below 30mph and he is clear.
A tacho chart only provides proof of time, distance and speed when it is removed from the machine by plod/ministry. And then only from the point when it was last opened.

No, with respect you are possibly looking at it too simply.
A tacho chart can provide evidence to a determined investigator revealing far far more information.
As stated previously it can even "prove" the route you took. It can certainly prove the exact speed at a point in time, is there repeated excessive acceleration followed by hard braking, how harsh IS the braking and so on.
Your method may (repeat may) stand up to a cursory examination but not to professional analysis.

Agreed.
But it cannot "prove" the date of travel. Thats why I said it`s only really relevant if the investigator removes it from the head.
Agreed.
Assuming that as normal the chart is dated signed and all the fields filled in, and that the person filling in and removing the chart subsequently gives evidence on oath to those facts.
Then if that evidence is discounted it can only be due to being subject to the rule that "All witnesses are equal, but some are more equal than others."
Unfortunately too often the case.
