You are sort of correct - the cameras are often operated by a 'camera partnership'... but they are often Police employees. For all intents, they can be considered an agency of the Police. You *MUST* reply to the request for driver details or you get charged with another offence - that of not providing details.
As far as I can tell, you are just in the threshold for a course. 30 + 10% + 9 mph. So, no points, not even a fine (technically), but you have to pay to go on the course. No guarantee you get offered this though.
It is an argument as to whether the cameras improve safety - but that is just the way it is.
Again, if you are truly believing you were not doing 41 mph, you have the option for Court. Again you will need to prove your case (all the camera partnership need to do is present their measurement - and usually associated video)
As it happens, I had success when I got disclosure of video against myself. I won't go in to too many details, but the video supplied assisted my claim and the case was discontinued.
So far I have seen you cite the following as in some way a reason to fight this:
1. Fixed speed camera is blue
2. Van not painted the right colours
3. A photo of you in traffic behind another car
4. Some sort of community should rise against this debate around a blue speed trap
5. Agencies used by police to enforce traffic speed limits
6. Cameras are for making money not for safety
None of the above apply unfortunately in terms of getting you out of this fine - you need to get evidence then present it in court against the offence.
