I've received a notice of intended prosecution but they have Speke my name incorrectly, so it's not actually me. Does anyone know the course of action to take? Thanks.

If it is an obvious typo, the principle of de minimis will likely apply.

If it is a complete botch, you could return the forms indicating that you, "Mr Thankyou4calling" are not the person addressed. Of course, you must complete the s172, and if you are the RK for the vehicle, you'll likely simply receive a revised form.

Thanks for info. It is a simple spelling mistake. However if they got one letter wring in the registration it is not that car and one letter wrong in the name means it is not me I thought.

I don't spell my name that way, never have done.

Does it still apply in which case why bother with your correct name.

FFs, its a simple spelling mistake, if you are guilty, then just pay the fine and move on.

Always people like you trying to worm out of there mistakes, just grow up.

If it is the right car, it is likely to apply.

The letter was for the RK of the car, which is you - even if they have misspelled your name by one letter.

I hope you can wrangle out of it, as I don't believe it should not be enforceable if they cannot complete their process properly - but the law may disagree.

Seriously though, its a request for information as to who *was* the driver at the time from the RK, check your V5 to make sure your name is spelt correctly on it, I've had a V5 come through with a totally wrong name on before and lots of people don't check (even though you should).

You should respond back within the time limit with the drivers details (if known) or a damn good reason why you couldn't find/get them. If your reason isn't good enough you'll get 6 points.

There are suggestions that you can string it out as long as possible, depending on how it happened (speed camera van's video everything and people have requested a viewing to 'aid identifying the driver') in the hope it'll time out but that's your call and chances are slim. Still, not a lot to be lost by sending everything (special delivery) as late as possible, just make sure you do send them within the time window.

You should have just sent it back to the return address with a note on the front 'not known at this address', then just sat down in a chair, gently rocking back and fourth going "La, la, la la la..."

Try asking elsewhere, PH is like Mumsnet these days.

I recently had a speeding case against me dropped due to a technicality and I recieved similar answers on here - you did the crime....

The speeding rules / punishments are massively out of date and unfair I think we should all be helping each other to avoid them whereever possible.

Pepipoo is worth a look.

I am sort of with Redgriff.

If they can't get name and reg right, how can they be sure the speed is right? That the Speed limit is lawfully applied etc

Case law on this suggests that if the OP wasn't misled by the error, it doesn't count. Clearly if he understood that the NIP was for him it's not an issue. I'd imagine the same mistake is on your V5c; it'd be worth checking.

None of this would be a problem if they simply employed BiB to make the stops.
It's only because they want to do it on the cheap with cameras...

I got a ticket for my wifes car (it was in my name) and after first having a laugh because she had not told me - discovered it was on a date at which we were abroad on holiday.
Returned the S172, saying so - and was asked to name WHO was driving! Not sure why they thought I might know - since I was abroad!

It is obvious that they get the details from the DVLA, so if there is a spelling mistake which is not on your V5, then the back room staff must be illiterates!

I appreciate the desire to evade, avoid or otherwise obfuscate speeding offences and the like. As others have tried to tell the OP if you were driving the vehicle at the time of the offence a minor clerical error is not salvation.

Were you there?

Did you commit the offence?

If not, plead not guilty on whatever reasonable basis you have decided upon.

If you were guilty, tough. Plead guilty. Your right foot is bad for you.

For a speeding offence (which in most cases is just bad law), the above means nothing if proper procedure has not been followed by the authorities. Every effort should be made to clear yourself. Hopefully, the authorities will then not repeat any mistakes.
