I need advice.

I was stopped by Thames Valley Police for doing 95mph at the M40 sometime last week. I was given the usual lecture and was handed a fixed penalty notice - 3 points and £60 fine. Had to go to the police station to hand over my licence and insurance papers. When going through the details, I noticed that the policeman who stopped me failed to sign his name, rank and details - an oversight at his part.

I challenged the validity of the fixed penalty notice as the officer who stopped me failed to sign it but the local police said it it still valid.

Is it??

For 95 in a 70 I would be tempted to take the FPN. It is borderline to a ban as is...

I think provided that his counterpart is signed by him on the back then it will be fine as he signs to say that the front copy is an original.

Should there be an issue then i would assume that he would just do a statement saying he handed you a copy but forgot to sign it.

End of i think as you looking at my pack of tickets have signed the paperwork accepting it.

I think I would take it rather than risk going to court and a heavier penalty, unless you can afford a brief to find out otherwise.

Ticket is still valid. No requirement for the issuing Officer to sign it. Of course its common sense, but an admin error on the part of the Officer will not invalidate the ticket.
