a few months ago, I recieved a letter from South Wales Scamera Partnership.
Went through the rigermole of asking for photo evidence.... recieved it, and concluded it wasnt the wife, so must have been me.
Filled out the forms, popped them back in the post second class (the same way they were sent to me).

Nothing for 8 weeks.... then, last weekend, a second set of pictures turn up in the post! No paperwork, just another set of pix of me driving with the speed printed on one of them.

Im starting to think SSCP aint got a clue what they are doing .... Ive identified myself as the driver, posted all the paperwork... now nothing !....

I hope you kept the envelope ... 2nd class is not approved for sending NIPs (I presume it was a NIP/NOIP). I also hope you didn't send your reply within the 14 days they have to send you the NIP ... or that might weaken your case.

Sect 1 Road Traffic Offenders Act 1988 - a person shall not be convicted of an offence unless ... within 14 days of the offence ... NOIP SERVED on him or Registered Keeper.

Sect 1A (c) ... may be SERVED by sending it registered post, recorded delivery post or first class post

If the NIP was not sent first class the NIP has not been correctly served ... so there can be no conviction.

Note that a 29p franking is actually 1st class.

Cheers for that Streaky.

All corrispondence was sent back within 28 days of recieving it.

Definatly second Class on the envelopes ....
Its a buisness reply frank with a huge "2" in the top right corner.
All other corrispondence has a second class stamp affixed.

I find it remarkable that the police are allowed to send NOIPs with anything other than "signed for" delivery.

Given the known vagaries of the postal system, I would have thought it prudent to send them all out, in the first instance, by registered mail. That way, service is assured; but since recorded costs 100% more to send out, would it be cynical to suggest that cost is the motivating factor?
