got up this morning to a notice of intended prosecution on my doorstep - great start to new years eve...

The offence? 36mph in a 30mph

on Xmas day morning!

now, whilst recalling being flashed (it was near to my folks house) I also recall glancing down at my speedo and thinking - 'strange - I'm not 'speeding'...' (speedo is in kmh with the red marker at 50kmh, I was just over this)

simple question - I'm loathed to join the apathetic masses and just pay and take my points like a good little sheep - but I really don't have time to be buzzing up to Bedfordshire (where the alleged offence occured) to contest it.

Is there a simple argument that will mitigate my case?

i.e. an empty clear road on Xmas day morning is possibly not as hazardous a place as it would be on a school day afternoon?

or is there no justice in the world

I guess I won't be laughing when my insurance renewal comes around in Feb....

any advice gladly recieved...

Did you get flashed from behind? Unfortunately, the camera partnerships aren't known for their discretion or flexibility. If you were flashed on your way to hospital with the queen in the back suffering from a heart attck they'd still prosecute.

- I remember on a double flash I got some time ago, the options I had at the time were to increase speed by a few MPH to get round a cyclist, or kill them as there was a pissed / really crap driver coming at me half on my side of the road from the other way! So I got a nip for 34 in a 30 and when I called up the SCP (Cyclist was in the photo), they advised me that next time I should kill the cyclist if I didnt want to get a ticket

If you are really sure you were not exceeding 30mph then fight it. The photographic evidence should support your case.

Just over 50KPH = just over 31.25MPH, i.e. "speeding", maybe not according to APCO "Guidelines", but ... . (and, FWIW, 36MPH = 57.6KPH which some might think was "just over 50".

And, in the Scamerati's binary world there is no "justice".
