Afternoon all,

I sold a car to someone at the start of July, due to it being a rush job it seems the V5 change of keeper part has not made it to the DVLA as expected. They promised to sort it online from their end, but clearly haven't due to being a massive tt, because I now have a London ULEZ fine on my doormat. No doubt something else will soon follow because the vehicle was, and still is, on SORN.

I have a bank statement that shows money going in from the same name as a message on eBay initially enquiring on the car. I have a photograph of the car leaving on their trailer with their numberplate visible, and the car has since been MOTd which will no doubt be at a garage local to them. They are in Enfield and I am in Liverpool so pretty geographically separate.

How easy is this going to be to fight please?

"I am no longer the keeper of the car "registration". It was sold to "name" on "date". Due to the time elapsed I am yet to receive the DVLA change of keeper notification but I will chase and forward when received. In absence of this please find screenshots of the advert placed for the vehicle, correspondence from the purchaser, bank statement showing funds received from same name and photographs of the car leaving on a trailer on the date of sale. As such please confirm cancellation of the penalty"

The change of keeper was posted and lost wasn't it wink

I wonder if it would help or hinder things if I texted the buyer and inform him that I will take him to small claims court for any fines generated since the sale unless he registers it and pays the ULEZ fee PDQ?

I wouldn't bother messaging, more hassle.

TFL are awful to deal with you so will likely need to email/call DVLA chasing for the confirmation of no longer being RK given you "posted the change of keeper slip to them on the day after the sale" - they may insist on seeing it...

As the V5C says, registered keeper does not mean owner (and certainly not operator). If you have the buyers address then you should be fine, if not things may get a bit more tricky (they will want someone to take the fall, and that can come back to the registered keeper if they can't provide details of who was driving) but I would certainly start by contacting the DVLA to un-register yourself as owner. You may end up paying this fine, more importantly get it sorted so there are no more.

Do you have the 11 digit reference number (possibly from a photo) of the V5?

If so, you could do it online, and you could backdate it to the date of sale. Given its the seller's responsibility and not the buyer, and what with ULEZ, parking tickets, etc etc, there isn't really an incentive for a buyer to do it, especially in a private sale scenario. If it were "in the trade" its a bit different, because eventually you'll be tugged by the 5-0.

It is the sellers responsibility to send off the V5, I wonder who it was left with to do in the OP’s case. Who the driver was is irrelevant for a ulez fine
