My daughter is 11 - a couple of her friends who are over 5' came to a halloween party in makeup, heels, hair etc - could easily have been mistaken for 18+
You genuinely believe that an 11 year old can be mistaken at close quarters (I.e. not over a computer screen) for being aged over 18 ?

Some parents are morons. My wife and kids attended a pool party last summer. One of the girls there was 11. Her mother thought nothing of allowing her to go naked in the pool. There were dozens of families there (and fathers). This girl had boobs and bush. WTF was her mother thinking. If it had been my place I would have told her to get some clothes on.

From reading that, I suspect that if she'd been just a few months older, he may well have been found not guilty, but because she was under 13, even though the judge accepted that he thought she was over 16, that's not a legal defence.

And no way he spent any time with 13yo and mistook her for 19. Maybe in passing only would that br possible. Or wilful ignorance.
I have a 16yr old daughter. I'd be reaching for the carving knife if any 28yr old went anywhere near her virtue, but neither of us (I assume) know anything more about this case than what's in that article, and I certainly can't imagine either of us know any more about it than the judge who has presumably met both the bloke and the girl, so why are you so insistent that the judge is wrong in believing it was reasonable for the accused to think the girl was over 16?
Still potentially creepy, I agree, but that doesn't necessarily mean the guy thought he was breaking the law.
Where did the parents of this 12 year old girl think she was whilst she was spending the night with this 30 year old man?

young children can do daft things without properly understanding the potential consequences. They need to be protected.If an adult genuinely cannot tell the difference between a 12 year old child and a 19 year old woman, then they need to seek help and will end up on the register. Rightly so.

Personally I don't buy that a 12 year old would pass off as a 19 year old even on looks for anything more than a passing glance. Once you've had a closer look and communication it would be near impossible to pass.
They don't really say much about the young girl other than her "withdrawn state" and being either "unwilling" or "unable" to communicate. I'd bet that the young girl wasn't exactly your typical 12 year old and had some sort of obvious issues.
I guess the rape charges came about as

this. if she was maybe 14/15 then it's possible she could be mature beyond her age mentally and physically but 12 is basically an infant edit: was reading reddit about this and some people were pointing to a famous Brazilian instagram star melodyoficial3 who is 11 who admittedly looks 17+ easily. I suppose makeup etc does make a big difference
