Seems a little harsh to me (and sounds as thought the trustees had already lost faith and were looking for any excuse).

Gut reaction says yes, the holiday might reduce the stress.

However, wrestling a shark whilst on holiday is not the reaction of a stressed person!

I was under the impression your employer had no say what you did while signed off with stress.

It does rather look as if they were taking the piss. The big question is, were they on paid sick leave?

Odd that they're both off with stress?!

Nevertheless, taking a holiday seems quite a sensible thing to do if relaxing is what's needed.

Work related stress (for both of them) from running a small charity? Really?

People like this are (IMHO) worse than the career unemployed. At least there's a base honesty with the 'won't work' lot. These sorts of people can destroy small businesses and they won't give a toss about the genuine stress they cause to other employees who have to pick up the slack.

surely he can sue if hes signed off for stress he can do anything? not as if he has a bad back or something.

unless, of course, you are engaging in (none agreed) work.

a lot of people seem to assume that if someone on authorised sick leave is 'well enough' to travel / go to the shops / not be bedridden they are well enough to work ...

unfortunately senior management in charities especially volunteer senior managers consider themselves to be above the law ...

Just being sacked doesn't mean it is not ok. It may well be up to an Employment Tribunal to decide.

Both off with long term 'stress' and happen to go on a two month holiday to Australia during which you wrestle sharks?

I would've sacked him as well.

Hopefully the charity have gone about this the right way. Even if they are morally in the right the situation seems on the face of it to be a huge minefield with regards to employment law.

I can see there maybe being a clause about remaining available when going off sick which may get them but firing them for a gut reaction might prove problematic. If he was claiming he couldn't walk or something maybe but not when he is off with a non-physical complaint.

If one of my guys was genuinely suffering stress I wouldn't begrudge them a break however a couple who both go off at the same time and take a 2 month holiday. That would raise some eyebrows. The length of the break suggests that they were not overly willing to come back and had decided that their stress would last at least that long.
