The HRA is all about interpretation from what I have seen/read. The Courts have taken it somewhat to the extreme.

If we got rid of it and replaced it with something new, who is to say the courts would interpret any differently? The only way they would is if the law had much more detail about what your rights were limited to.

From what I understand the HRA was lauded as something brilliant when it came out because it meant you didn't have to go abroad to enforce your rights. Bit harsh to criticise Labour for it now isn't it?

It would be interesting to know the grounds on which this person claims asylum. If he wasn't Janjaweed, and hasn't killed anyone, then what else does he have to fear upon return? Or has he shot himself in the foot in his desperation not to be classed a war criminal?

The main problem with this guy is that we don't currently endorse capital punishment and if we send him home, where he is likely to be killed, that's kind of sentencing him to death. What we need to be doing is making him work for what we are currently giving him, but not at the expense of a British citizen.

No, they signed us up for it and wrote it into legislation.

Let them all in, hand out some money, give them housing, nhs, english lessons-then TELL them they cant work.

JESUS H CHRIST.

Terrorists and mass murderers - and we send someone to jail for telling a fib about speeding points, because he perverted your lord ship.

Spend your energy where it is better spent, on problems like this, real every day problems.

England, get a grip.

I suspect it may be others' feet he's shot, and other parts.

But hey, look at the positive message this sends out; we're so tolerant, forgiving and welcoming we'll even give sanctuary to mass murderers, war criminals and terrorists. I bet Radovan Karadžić and Ratko Mladić are miffed that they didn't think of this and get themselves here before those pesky judgmental types at the Hague got them. Do you think we should tip off Assad?

We signed up to it in 1950 - the European Convention that is. Those rights existed for a lot of years before the HRA. By putting it into UK alw it made it much easier for people to bring claims - but were there many people saying we don;t need a HRA before 1998?

I seem to recall a thread on here last year when most people were in favour of the HRA - its just the way it was being enforced they didn't like.
