Looking at some of the photos, it probably does fall under the 50% rule, possibly they have found it breaches in some other way.

The internal height looks way more than 4 metres, but in this case does height mean 'height above ground level'?
Actually, scratch that - photo 7 on the Sky News page shows a massive steel frame. From the Mail, the council had been advising him all the way through to apply for planning permission, but he disagreed.
