sorry to a different online buyer

but anxiety and paranoia are a bain for me "if they went skint, mine might go skint" and on and on, the money cleared yesterday afternoon so all good.

i checked my online payments 7 times over 2 days to make sure i had paid tesla and not some random account lol

just checked it again as i have not had confirmation of payment received ....

Guys, one of the unlucky ones. Sell Your Car received a deposit for my car on 3rd September and I believe sold the Ford Focus ST3 (my wife's car) to a 3rd party - no money received.

Liquidators Begbies Traynor say there is little chance on getting any money back - and certainly not the £14k owed.

I'm applying to DVLA for details of the new owner as the dates sold and then declared liquidation will be needed for any court case - I will be taking these (insert swear word here) to court, no doubt about it. Anyone who needs the same DVLA information (on a 3rd party sale) will need to complete a V888 form and send it into DVLA. Waiting time can be up to 4 weeks (although 2 is the norm).

Unfortunately, this has put me off using these kinds of companies to sell any future cars for good.

Nothing to add but my sympathies. These kinds of firms clearly need more stringent regulation as this is sadly becoming way more common. I hope you reach a happy ending.

People legally do this stuff all the time, nothing will happen to the owners of these companies. It's all legal. I've seen MUCH worse and the people are still at it today.

Very very occasionally someone will be made an example of, but it will be worth it for the vast profits they will have squirrelled in to bitcoin or similar.

I purchased my C63 from them last year. Apart from getting it wrong about a luggage cover, they were OK. Interestingly, they had nothing good to say about Herts Prestige.

Actually, I purchased my Tamora from GP Cars as well.... I guess I got lucky both times, will keep my eyes open in future.

Who will you be taking to court?

Sounds as if the company owes you money but the company is bust so as a creditor you’ll get pence in the pound.

That's really sad news for anyone who was using them to sell a car! mad

But surely going down the "Sale or Return" path has to be fraught with hazards, and especially with operators like this?

I've only ever PX'd or sold privately - even WBAC would be a better option.

Thanks Marcellus, but when you feel this angry about being cheated like this people tend to write what their first thoughts are before knowing the facts. Your sympathy to the 50+ people affected by this company liquidation is comforting.

It's a shocking situation.

But in legal matters, especially chasing funds that either no longer exist, or are squirrelled away and untouchable, a healthy dose of pragmatism is needed - otherwise it can consume you and your savings.

Pay for good advice (paying for a good solicitor from a top firm will save you money in the long run) and take their initial advice. The professional solicitors will advise if you have a case or not. The poorer ones will milk you...

I disagree, I think there is a strong case here to pursue the directors, but you will need very good legal advice and support, and that will cost.

You would have to in effect prove that the director(s) acted in a manner which undermined their statutory duty to act in the best interests of the company's creditors as a whole.

That may include:

- Deliberately causing company debts to increase or go unpaid
- Paying some creditors (I.e. Themselves) and not others, this is showing favouritism
- Not acting in the interest of creditors whilst trading insolvently
- Disposing of the company's assets at undervalue or no value

It's very rare that any case against directors is successful, but in this case, with the history of companies dissolving and Pheonix'ing, I think it'd stand a chance.
