Hello,

Just after a bit of advice, would it be acceptable for me to ask for a breakdown of exactly how they got to the figure they will be paying out to third party after a claim against me?

It is an absolutely crazy amount; however the lady on the phone said she couldn't send me exact details and could only tell me the basics over the phone? Surely if it is effectively a claim against me I should know exactly what has been paid out?

They should be able give you a breakdown between injury, property damage and legal fees. Bit surprised they're being cagey about it but they probably don't get asked about it.

When you next need insureance you will well be asked for the value of the claim, you need the infoirmation from them.

Personal view - When an insuarnce payput is made then the policy holder should be sent a statement of the amounts involved. I challenged a claim just before payment was made as the other party was taking the piss on the hire charges, he ended up paying most of them!

Hello,

Well yes considering it's just under £7k for a scratch on the side of their car (which didn't even go to primer). I would quite like to see where all the costs have come from! Hence I asked and was told they could not provide a detailed breakdown of costs, only the amount.

Note : There were no injuries so hasn't come from that.

Am I right in saying if I push them I should be able to obtain this information?

Yeah, if everything is above board they shouldn't need to hide anything, get on to them.

No - because the Court of Appeal said so in Bee v Jenson.

Basically you have no right to know the contractual arrangement between the third parties (i.e. their commission etc).

It's probably £200 to repair the scratch£4000 of hire car charges forced upon the other party and the rest is the commision. Call me cynical

I hit a non goer at a roundabout around 8 years ago. Totally my fault she said it was ok only a newish but battered disability focus.
It was just a few added to scratches on her bumper. I gave her my number and said to her to get a quote and I'll pay it. I heard nothing then two weeks later her insurance phones me and it's been put as a claim.
Then an accident management company gets involved. It's gone from a £200 scrape if that to over £2500. Hire charges from the garage whilst they quote then two weeks hire car whilst they fix the car. This is why insurance is so expensive. Also instead of respraying the corner they replaced the bumper. I claimed betterment as the rest of the bumper was scratched and scraped. My insurance company couldn't care. And I lost two years no claims bonus.
