child in a booster seat in the front legal ?

my 5 year old son has autism and loves to ride "up front with mummy" when ever he can. We have a disco, and loves to see over all the cars. However one of these community not real Bobby's pulled her up to day and told her she was breaking the law. a child has to be 13 to sit in the front seat. Now my son is 5 and 112cm tall. When he is in the front he is always in his booster seat. I know some people frown at children being in the front, but i never thought this was illegal. Have i misunderstood the law here. Have i and my wife been law breakers.
