Depends how good his legal council are.
Can you actually see the key against the car from the dashcam?
What I can see is a guy fumbling in his pocket, removing something, and then walking alongside the car and out of shot.
If the guy gave the key a good clean & there are no corresponding traces of paint or metal found on it, what real evidence is there?
You seriously cannot hear the scraping on the car as he walks down down the side? Can you actually see the key against the car from the dashcam?

£5 says he will be fined less than £100 and/or given <100 hours of community service.
Damaging other peoples private property carries pathetic punishments.
He's had a life of suffering and abuse, it must be hard to bear the name 'Gary' knowing that its dying out.Damaging other peoples private property carries pathetic punishments.
Part of a 'one two' punch routine where his parents gave the knockout blow by handing him the second name of 'Eugene'
Poor fellow may be given compensation rather than a fine or other penalty.

Sadly I suspect you will be right. Damaging other peoples private property carries pathetic punishments.
Could the owner of the car could pursue costs through small claims court if he is prosecuted?

Top tip - don't post videos on youtube of "criminal" acts since that may create inescapable prejudice...

Yes. And it's sad but the defence lawyer for the accused can simply show the number of youtube hits and possibly persuade a judge that the jury pool has been poisoned by this "evidence" that was not presented to any potential jury after due process.

Why is everyone carrying on about a bloody jury??Top tip - don't post videos on youtube of "criminal" acts since that may create inescapable prejudice...
It's not going to be heard by the Crown Court, it's a summary offence. Could you imagine how much slower (if possible) the court system would be if every offence was heard by a jury??
The images of the accused were released by police (and other sources) as the accused was unknown and his 'assistance' was required to see if he could provide any information in regard to the offence.

I agree he did it, and I hope he gets a whacking great fine, but I was trying to play devils advocate because these things often play out differently to what is expected.

...you can also see the keys make contact with the car...
I can't.Burwood said:
No disrespect but you're blind. Slow the video frame by frame it is crystal clear..
Absolutely, in my eye's you can clearly see the key touch the car. To back this up andeven more distinct, you hear the noise as he runs it down the side of the car, no brainer, open and shut case!!!!!

It's a physical impossibilty for the camera to see down the side of the car.
As I said, we all know what happened, but I would imagine a solicitor would argue the point that you don't see any contact.
