CTR - VTEC goes bang

I can't beleive i've done just under 11'000 miles of faultless motoring and a few weeks ago i started experincing the VTEC cutting in and out under heavey cornering. So I booked in with the local dealership and took the car down this Saturday and set off for a test run with the engineer so he could experince the problem first hand - naturally like everyone else i've consulted drew a blank and we returned to put the car on the diagnositic thing. Just as we are approaching the dealers I started hearing a loud tapping noise at anything above 3k rpm and we limped onto the forecourt. No warning lights - just tapping.

They then roll the car into the garage and leave me bitting my nails in reception and with 2 sips of shite coffee the service mgr reports the bottom ends gone, WTF how could this be.
Also they have questioned the HKS filter which may invalidate the warranty, where do i stand on this one and has anyone had a similar experince.
Any advice welcomed
