I did. What isn't immediately clear in the video is that I pulled forward ahead of my line but before their lane as I saw the Stobbart lorry had zero intention of stopping, which puts me in a position where I can absolutely seen from the traffic on the right. I also saw the van slow to an almost stop and then just as I committed to go, he decided to do the same thing, which is why there's a suspiciously large gap between the Stobbart lorry and the van.

I presume he has dash cam from his van of the green light then? Otherwise, have they seen your witness footage, or just being awkward because their policyholder is in denial?

Unreal ....maybe a standard stance for the other party insurers to try for 50/50 and they dont have any details of your evidence yet ?

We had a situation a few years back with other halfs car written off by a foreign lorry changing lanes into the side of her without looking. Driver admitted liability in front of witnesses at the roadside, subsequently lorry driver insurers tried going 50/50. When challenged and told them see them in court and why they backed down.

Guess they will always try for a 50/50?
Anyway, you have solid evidence all in your favour. I wouldnt worry about it.. but it does mean they will drag it on for a long as possible which is not ideal.

I think they're totally confused about having nothing to lose. The daily storage charges for the bike aren't going down.

But if they win they'll be halved... A couple of weeks dispute is always worth it to them.

Good news!

The van driver was interviewed under caution yesterday. He was shown the video and when he saw how big the gap was between my green and him going, he broke down into tears, admitted liability and is being charged with due care. His insurance company did pretty much the same thing and have accepted liability.

To balance the above, "when memory comes into conflict with pride, memory yields", he might genuinely have convinced himself you were in the wrong as he couldn't handle it. The fact he broke down also shows genuine remorse.

There's a good chance the best outcome here has happened, you are ok, you have been compensated as best you can be, and this individual may learn a life lesson here.

Great news. I’m glad that (a) the cops got their fingers out; (b) van driving tosser has thrown his hand in and (c) insurance company, likewise.
