How cam I sue these bds for breach of contract?

My broadband regularly goes off for around 12 hours about 5x / month.

I've emailed them loads of times and they don't bother replying.

It takes literally hours to contact customer support in India.

I can't understand what they're saying and they've no idea why my BB is off.

So I'm locked into another year of this failure to deliver my BB.

Can I stick a claim for compensation via the SCC or is there someone to whom I can complain who will have a go at them (off trot or something)?

Basically Talk Talk need to be shutdown.

When anyone ever asks me about who they should use as an ISP I point them in the direction of the Talk Talk forum.

After they've read a few posts they cross TT off the list forever.

How these muppets are still in business I just don't know.

Yes I know I went with them but it was in ignorance and I've paid the price several time over now.

Ofcom it is then.

I just posted something in the computer forum. I am having the same problem as you with my internet dropping out every so often. The pc says its a DNS error.

I have held off phoning TT as I hate call centres.

I don't see how they can hold you to the contract when their service is not fit for purpose.

I get the same service from them and its always the "its not us its you" line from them even when Sky worked fine! I am trying to sort something out with trading standards (I work the floor above them) to try and terminate my contract without paying. Also if the rumors are true they refuse to give out the MAP (think thats the term) key and charge you for it

i am talk talk, and the 2 times i have had major issues, i spent days trying to get anything done on the phone. used the forums and both times the issue was resolved within 2 days.

i am not saying they are great, just that they do get stuff done through the forums

i am so so about talk talk, but i hear too many horror stories about other isps to make me move away at the moment.

I have to say, I'm with TT and after 6 months of usage, haven't yet had any problems.

Now I have said that though, I am sure I will be beset with issues!

I was signed up for the free broadband deal a few years ago.
It is a very long and tedious story, which I won't bother wasting my time typing.
Suffice to say, the service was appalling. I sold my flat before the 12 month contract was up, so paid it off, and cancelled it at the same time. That wasn't good enough for them. Some 18 months later, they were still sending letters, and knocking on the new owners door!

I wouldn't use them again, if they paid me.

We've been with talktalk for a while now.

Few issues, but the big one, wasn't actually they're fault, some engineer had wired up the local cabinet wrong and messed everyones lines up.

I had issues with their DNS servers not seeming to work, I would get the 'Page not found' quite a bit. So I switched to google's DNS, and that seems to have helped.

Talktalk are the only LLU we can get out in the sticks, and at 3Mb its not half bad. And we've been regularly going over our 40GB usage, and they've not said anything, just capped the speed in the evenings. Didn't realise we'd hit 75GB last month, biggrin.


Before you go and blame talktalk entirely, make sure its not your internal wiring/external wiring, local cabinet etc. Our cabinet is rubbish and old and when it rains, the broadband usually takes a beating as the box leaks, biggrin.


You should just be able to cancel through Talktalk by stating that the service you are receiving is not acceptable / not whats advertised. If they start trying to get off the hook, you can then mention that if your contract isn't cancelled you'll take it to trading standards and they might then do something.
If they refuse, then definitely go to TS.

As much as I like talktalk, they're customer service is probably one of the worst, probably due to being associated with AOL, biggrin

Ask for a MAC code. Pretty sure that legally they have to provide one, then it's between you, them and the courts.

pretty sure their service is billed as upto 8 mb, eclipse had the same thing and 50kbps is within the remit,

I was with Nildram for years...they were taken over by Pipex, and all was well. They were then taken over by Tiscali, and I DID get worried. All was well though.

Then, they were taken over by Talk Talk. Downhill it went, rapidly. Connection probs, obvious throttling....

Within 3 months I migrated to Zen .

The fact remains, with ISP's , going for what seems the most competetive package is usually, a bad idea.

Zen is not cheap, but their C/S is superb, speeds are very, very good, I have no probs.

Sometimes, you really do get what you pay for.

Thanks for all the replies - interesting reading.

It's working at the moment so I've calmed down a bit.

Took a look at Ofcom but they are not the right organisation to deal with BB issues.

Trading standards sounds more likely to get results.

My issue looks mainly like a DNS one so I'll try using free DNS servers and see if that helps.

On bills ,if you've got any paper ones ( or perhaps on contract ) there will be a overseeing regulator ( if not Ofcom ,then perhaps OfteL) .But ,of it's like any other scheme set up by the Brownies( the Brown /Blair hopeless party), you'll have to write in to complain ,give them a set time( about 8/12 weeks) to rectify before you can take /ask for outside action . And - "don't forget " -send any complaint "Track and Trace " ( in old language Recorded )-then if you get a chance to go on line ,get a copy of the receipt declaration and save it .
