Bought a car from a trader recently. Supplied with a 3month warranty. The car is a 97,000mile old 1994 BMW M3 so quite old.

4days after buying it the car starts having problems. Turns out that the metal casting for the Vanos (high pressure oil system that controls the timing) has a hailine fracture thats leaking and causing the unit to lose pressure and malfunction. Unit costs £1614.95 plus fitting and various gaskets from BMW!

Trader says his warranty man wont cover it because its wear and tear on a car of that age.. but he'll pay half the bill (for a 2nd hand unit only).

My view is that this is not a moving part, not subject to wear and is simply a totally unexpected mechanical failure exactly the kind of thing a warranty is supposed to cover. Any knowledgable comments about these warranties before I take it to a small claims court to decide?

Speak to them first. On the face of it though it sounds like you have grounds to either reject it or demand it's repaired fully and at his cost.

First 28 days, full repair costs or money back.

Have him fix it, or ask for a refund - it's only been 4 days after all, which means it was probably like that when he sold it.

Does you car insurance come with legal cover? If so, use them.

Justin says whatever third party warranty *he* has to cover his requirements in law, this does not affect what he must offer to you.

He knows full well of the outcome being him paying in full, but is obviously trying to save a grand or more by getting you to agree to something else.
