I have been told that the owner will get three points for not sending back the form as after 6 months the driver cannot be prosecuted but the owner can pick up the points even if he can prove he was somewhere else at the time .So how can u get 3 points for sitting in the house? surely 3 points comes from a driving offence not a form filling offence ,is this a human rights issue. by the way i am in court wednesday

Nothing to do with the six months. It's because he didn't supply the required information.

Not as far as the owner is concerned; he is not the accused.
Even in respect of the driver, U.K. law says that it's in the public interest that drivers, uniquely among criminals, be compelled to confess in the form of a signed witness statement.
That is being appealed to the ECHR, but the case won't get there until 2006.
