I have just been filling in my NIP form (I haven't decided if I will send it though) on the penultimate due date and noticed that my address and name is incorrect.

Whats the craic regarding this sort of admin error?

Your topic is wrong postcode - but you say the address and name is wrong...

Can you elaborate? I doubt you'd get away with the postcode being wrong as long as the address is correct.

But if they've called you B.Smith instead of F.Bloggs - then I think you could be on to something! I'll let the legal bigwigs fill you in on this though

The address has the following errors:

1)Wrong area (although that area is only two streets away - even so, my street is technically not in that area at all)

2) Wrong postcode - the last two letters are close but not the right ones

3) The NIP is dated 26th April and the offence 20th March. It did come through a hire company and i know the first one was received there within the 14days rule.

4) my name is incorrect in as much as my first name is repeated twice i.e. Phil Phil Earl

Are any of them worth fighting...?

THanks

Buffalo - seems possible that the original NIP went to the hire company, who may have filled in your details incorrectly and sent it back to the issuing authority.

If that is the case, I don't think you'd avoid a prosecution on this alone. I'm sure JeffreyArcher, DwightVanDriver et al will be able to offer some accurate advice.

As far as the NIP is concerned, IMO forget it.
If you had not received the notice and, as a result, had been charged under S172 (failure to supply), the incorrect address details may have lent credibility to your assertion that you didn't receive it. However, that is not the case here.

Do you mean just sign and return it...?

Myabe what is being implied is that if the address on the envelope is also wrong then you may not have got it cos it would be delivered to the wrong address??

Sorry, I wasn't suggesting that course of action. I should just have kept it simple.

I'm a cop and my sister had an NIP where her name, road name and postcode were all spelt wrong. Sadly it doesn't make a difference, as long as it's your car reg, and registered to you.

The people at the process section can't type, that's all!

If the name and address are *that* wrong, are you sure it even arrived?

Actually its not my car and isn't registered to me either! It was a hire car.

I was just curious really, but just to play DA for a minute; if i went to court and the magistrate asked me if i was Phil Phil Earl, of "wrong address" "wrong postcode", then i would truthfully answer no. The picture they will have of the car is of the rear, thus i doubt it shows me at the wheel...

How is that any different to returning NIP under the same reason? And how do they prove it was me?

I'll put the silly thing in the post tonight anyway, and spank myself for killing thousands of people with my excess speed on a deserted 50mph section of dual carriageway at 1am in clear visibility....

thanks for replies!
