Ok, paperwork back from Court yesterday, DJ is asking for mediation. I got another letter from the Court today saying that the claimant wants mediation too.

I can honestly see no middle ground, nothing to mediate, but don't want to look obstinate in the eyes of the Judge or Court.

Any thoughts from our legal types?

I think I'll give them a call and see what they have to say.

I'm not prepared to make any offer whatsoever other than to agree to discontinue- I see no reason why I should.

Mediation attempted today... ie I'll agree to him withdrawing his frivolous claim. Haven't heard back from the mediator yet.

I'll give the mediator a call in the morning and check progress, either he's taking his time to decide or we're going to court as it's been listed for January.

Bloody waste of everybody's time- could one of our lurking legal people indicate what I can claim in costs please- understand its rather limited in small claims?

I phoned the moderator, explained my position- and the circumstances.
The moderator said they'd contact the other party and that was the last I heard.
I made a call to them this morning, but there were no further notes on the file and the lady I spoke to wasn't in the office today.

Not a word. Called the mediator last week, they said they'd call me back but didn't. Assuming there's no news and we're going to court - providing the fee is with the court by, I think, 19/12

I spoke to the mediators office again on Friday. Seems they've 'explained' the situation to the claimant and he's gone away to think about it.

At this point we're still going to court.

Nothing to report- assuming he's paid the hearing fee, we're in court at the end of January

DJ made order that claim would be struck out if payment for hearing had not been made by Thursday. I intended to ring and check yesterday but didn't get round to it. Will ring and update on Monday.

I've just spoken to the court, he didn't pay so the action has been struck out.

What an absolute pain in the arse. Don't get me wrong, I'm pleased to not have to go to court, but I was happy to do so as I've done absolutely nothing wrong!

Anyway, thank you all for your help and assistance, I really am very grateful.

From memory he had to pay by 19th December- as a result, the order to pay by the 11th or be struck out has been sent.
