Tax disk and private reg?

Quick one.
Changed my reg for a private plate. Log book came back today with new reg on and it comes up on the online tax check as the new reg. I have told my insurance company of the change but the problem is the tax disk is still on the old reg and the replacement has not arrived yet.
Can i still drive the car legally? Will that tax be a problem if i got pulled over?

You would be unlucky to get pulled, but if you Wait for the official paperwork to arrive that gives you the approval to swap plates. Can't be more than Tuesday. I have just taken the plate off my Cerb to put on a retention certificate. Because I was unsure if the procedure had changed I did an email enquiry to the DVLA.
Here's their reply.........
"Only as the vehicle keeper do you have entitlement to apply to retain a number. The keeper should not sell or dispose of the vehicle until a transfer or retention has been completed and a replacement V5C is received, this can take up to 6 weeks. If the vehicle is sold or disposed of before a replacement V5C is issued, the entitlement to the number may be lost.
Hence you should apply to do the retention application first and then transfer the vehicle over to the new keeper afterwards.
Please note the keeper can apply to retain the registration number in a buyers/friends/family member’s name. The V778 Retention Document will then show that person as the 'grantee', or retainer, of the number. However, by doing this the keeper will pass on the rights to display that registration number to the named person.
Please note that for vehicles to take part in the Cherished Transfer or Retention scheme, they are required to meet the following criteria:
• be available for inspection
• be subject to either MOT/PCV or a Goods Vehicle test
• The tax disc from the vehicle which the number is being transferred from must have expired or have been refunded with a continuous Statutory Off Road Notification (SORN) made within the last 12 months.
In order to retain a number the following documentation will be required:
• V317 application to transfer or retain a number
• V5C Registration Certificate. If this is not available as the vehicle has recently been purchased or transferred you can include the V5C/2 "new keeper supplement", but this must be accompanied by a V62 application for a vehicle registration certificate.
• current MOT Certificate (if applicable)
• payment of £105 to retain the number for twelve months, £130 to retain the number for 2 years and £155 to retain the number for 3 years. Please note the assignment fee is included. When you are ready to put the number onto a vehicle, you will not have to pay an assignment fee.
This application needs to be sent to DVLA, Swansea, SA99 1DS.
DVLA will allocate a replacement number to the vehicle, currently carrying the vehicle registration number, which will normally be the previous registration number of the vehicle. However, if the previous number cannot be returned another age-related number will be issued.
Once a successful application has been received at DVLA you should receive a confirmation letter with the new MOT Certificates and tax discs within 2 weeks.
Your updated V5C and V778 Retention Document will be received within 6 weeks, unless you have submitted a V62 application in which case you should receive your new V5C within 8 weeks."

All the documents that were asked for were sent almost 3 weeks ago. As above it stated i would get the letter/tax and mot back within two weeks and the V5 in up to 6 weeks. Got the V5 but nothing else.
I've check online for the tax/Mot and insurance and it all comes back as ok.
The pain in the ass bit is the tax runs out next Saturday lol. Going to tax it online today and i wont be surprised if the new one gets here before the old one.

Sounds odd.....the V5 is usually the last thing you get back......however all the transfers I've done before (3) were through the local DVLA office, so in those cases we got the transfer or V778 first.
It might be worth an email enquiry to the DVLA....they've been pretty helpful in the past.

Sorry for the thread hijack, but I haven't received any documents or retention certificate back for my old car since trading it in to a main dealer on 13th August - the dealer took the whole V5C, MOT and copy of tax disc, got me to sign a retention application for my private reg. I've just emailed DVLA to chase up but my question is I have the old tax disc with my private reg on it (the one that was photocopied to send with the application) - can I submit this for refund now or do I have to wait for a replacement to arrive? Thanks
Just been thinking.......presumably the dealer will be sent the new V5 with the new registration number and a replacement tax disc, which he will either put on the car or apply for a refund. Your existing tax disc, with the cherished registration on it, will now not be valid and won't be able to be refunded......I'm not an expert but that what it sound like will happen.
Not uncommon at the moment it seems, they have even sent out a memo about it, can't find it at moment, but a link about it here.

IANAL, but in this day of robot enforcement, with fewer and fewer bodies on the streets looking for physical stuff, you'd be unlucky to get seen . Only problem might be is if you pass one of the dying breed( -a traffic car ,that still exist on TV) with attitude ,and get pulled . As I've mentioned elsewhere, I've got a notified suspect drug dealer opposite who'se been done for no docs on last car ,with a car sitting outside his house with ( from my informant) no insurance. We've had several patrols round and it's not been picked up .
