Sold wrong tyres - car dangerous.

Bought an Mg Tf a few months back, and about 6 weeks ago, bought new rear tyres. Only one needed replacing, but I ffigured, better to replace both.
Phoned around a few local tyre stockists with my preferred tyres in mind, and was told by a local stockist, that he had just taken a set of tyres off a car, and two of them, were virtually brand new with 6mm tread on, would I be interested in a cash deal.
Agreed, following morning, had them fitted, very happy.
Shortly before this, I had hit a pothole, and this had put my 4 wheel alignment way out, car handled terribly over 50 mph, but as I did not do many motorway miles (if any) thought I would wait to get the 4 wheel alignment done. Did this last weekend, handling a little better, but still not right.
Did some digging around, transpires that the tyres are completely unsuitable (side walls are not strong enough, makes handling very scary).
Have now ordered correct tyres, which are being fitted in the morning.
2 questions, 1) should I be going back to the fitter and demanding my money back, as they are "not fit for purpose", or should I just move on,
2) as they still have 5mm or so tread on, Is it worth keeping them and flogging them on eBay to recover done of my losses, or will I have damaged the tyre walls?

Is it 'feel' that tells you the sidewalks are not strong enough? Or are the rating of the tyres not right? Sometimes a different brand, or mixed brands, or even incorrect tyre pressures make a huge difference. As I'm pissed, I can't remember if you said you got it retracked... Alignment matters. The side walls should not make a difference if the are the correct size and loading.
Why come on here for advice give incomplete info and they say getting them replaced tomorrow.
Have you been on a rover.mg for advice?

What a car manufacturer recommends and what's safe are two different things. As long as the size, speed rating and direction is correct I would suggest the tyre fitter has done nothing wrong.Mg recommend certain tyres, and this is not one of the recommended tyres. use to work with a right muppet, got michelins fitted to his bmw z4 2.2 that werent runflats which I didnt know was possible but he ended up buying another 4 boots from a bmw dealer. "a fool and their money are easily parted"onyx39 said:

6mm tread is nowhere near virtually brand new, but if there were no obvious defects I can't see how you would get a refund on used tyres.Agreed, following morning, had them fitted, very happy.
Sounds like you got a good deal on a pair of part worn tyres and now think you bought the wrong ones?
Dunlop max sports tend to have a really stiff sidewall which is exactly what you need on one of these cars, the stiffer the sidewall the better - make sure you are not replacing these with so with something which is not much different.
( have owned MgF/Mr2's/vx220's etc tyres make a bid difference and you don't want soft sidewalls).

How much did you pay for the part worms? It's not like buying new tyres you can't really complain you should have done some research ( ps I'd rather have some Dunlop max sports on it than some cheap crap like Toyo's).

That's pretty much correct. The sidewalks ARE too soft, there is far too much flex when cornering and changing lanes on motorways. I am certain I bought the wrong ones, my point is, if I go to someone who sells tyres for a living, surely he should know what tyres need to go on what cars, and he gets it wrong, should be refunding me. Don't get me wrong, it's not a huge amount of money, it's the principle.
I put in my original post that I am changing them tomorrow, my question was, do I have grounds to ask the person who sold me (incorrect) tyres for a refund?
