It's perfectly legal to sell Tobacco. However, there are rules governing the sale of it.

My mum used to be quite a heavy smoker - we used to do the trip to Adenkerke a few times a year and she used to bring a fair bit back, all for her own consumption.
So the inevitable happened and she went into hospital to have a 3rd of one of her lungs removed.
Anyway, long story short, she is no longer a smoker, yet had several hundreds of pounds of her brand in the cupboard.
Thankfully she managed to find a local neighbour who smoked the same and she slowly sold them to her over a 4 month period and didn't make a single penny profit - so sold them at the price she paid.
But I was convinced I'd get a phone call from her one day saying she'd been arrested. HMRC take so a dim view at evasion of tax & duties.

No: see the link I posted. It would only be legal if they bought them with their own money and gave them to her as a gift. Note also that the amount you can bring in differs depending on whether the country in which they were purchased is in the EU or elsewhere.
Of course someone would probably have to have grassed her up for HMRC to find out. Or else one of her team had dropped the ball on the quantity brought back and an Customs officer at the (air)port of entry became suspicious.

Eventually HMRC will show an interest in this. Go to any local for sale group - always drink and tabs for sale, and i doubt people selling vodka (adorned with glitter or not) are lisenced.
Doesn't bother me though, to be honest. Facebook is just the new dodgy geezer in the pub wearing an oversized jacket!
