Kids under 13 with facebook - lives with father, visits their mum.....she set up the kids account when he was 10 so she can still access it - if she were accessing an adults account I assume that would be "wrong"...illegal? But if she is accessing her own kids (who is 12) - even if kid doesn't know - any problem?

Under 13 shouldn't even have a Facebook account.

It doesn't fall under RIPA or any of the acts dealing with comms. interception AFAIK, so the only potential offences might be under HRA, DPA etc. Probably overruled by parental rights and responsibilities.

However, it's a breach of Facebook's user agreement for under 13s to use it.

Surely checking up on your twelve year old's online activity is mandatory as a parent and not something to be questioned over its legality?

I agree, however, as posted above, isn't them minimum age for Facebook 16?

Surely that's simply terms of use issue with Facebook rather than any legal ruling. I can't see anything illegal with monitoring what your kids get up to online.

I think it's a moral issue more than anything.

A good idea to monitor but be open about it - both with the kid and the other parent.

13 as it's a US owned site and the COPPA legislation in the US set the minimum age for various types of online account at 13.

other age restricted websites tend to be 18 due to the nature of content .

get the child to change the password and not tell mum as ' you shouldn't let other people have the passwords to your accounts' conveniently skating over the under age aspect ...

A child of that age is a minor, as parents we all have (legal and moral) responsibility for our childrens' safety and well-being.

The mother may be accessing the account to keep on eye on the kids, rather than checking up on the fathers activities.

Although our daughter is over 13, she had a facebook account from about ten, and even now, we have access to it - daughter is fully aware of this though.

Not that that's a problem, keep your eye open and they will fail to lock their laptop sooner or later !

I always maintained password access into ours accounts but I always told them. Rather than trying to catch them out we tried to promote a thinking attitude to their internet access,

Totally failed of course, kids are kids but we only had a few occasions to 'have words'
