My next door neighbour did similar - he's an alcoholic. Blood sample taken at hospital.

It was months later that he was charged and the process of banning him began.

He stopped driving immediately and did say that in effect extended his ban by three months (there was nothing interim placed)

When you've had a few drinks it's hard to walk past your car on a very cold or rain night, especially when it's only a 10 minute walk, because what could possibly go wrong in such a short distance.

He can't be charged as they don't officially know if he was over the limit. The blood sample has to be taken away by the Police and analysed to determine the amount of alcohol in his blood.

Until they get that figure he can't be charged. When the results come in and if they are over the limit, he will then be required to attend the Police Station and be charged

Blood sample will be sent for analysis. Once the result is known proceeding will start.
It's not like the breath analysis where the result is known as soon as you finish giving the breath samples.
I can't remember how long it takes for the result to come back.

The drink driver in my street who took out my bumper a couple of months back is still driving, despite falling out of his van, trying to drive off and being arrested on the night.

Unlikely.... they have to let you sober up before reading you your rights and charging you. AFAIK
I meant "We're taking your blood for analysis. When we know what the results are we'll tell you what they are and take it from there. No, we don't know how long that will take."

Blood will need to be sent off and will take 2 - 8 weeks for the results to come back. He is likely to be summonsed after that to appear at court. I estimate around 3 months before he gets banned assuming he is over.

Though medication + alcohol + tiredness could be a possibility.

I know somebody who did that once, drove 100 yards from pub to this house and got caught, when they asked him why he did it his answer was "I was too pissed to walk" which, whilst I don't condone drink driving, I found hilarious though the judge did almost lock him up for the answer.

Aye, it's not the police who ban you - it's the court. So if the courts are busy or there are details that need to be clarified before the court case takes place - he's free to drive until then.

Courts are rarely busy when it comes to drink driving. Most will be in court inside a fortnight for those failing the main intoximeter. When the blood test results are back the OP's friend will be in court very quickly.

Why do PH allow posts (particularly the OP) to be deleted or modified after they've been replied to? This thread barely makes any sense now.

(I'm asking rhetorically and impotently of course, I already know no development occurs on the forum that doesn't service advertising)

I think for the original post to go it has to be done by a mod.

Who knows, it's the PH way ...

someone who has nothing to do with testing brakes said:
A neighbour came around on Monday all beaten up. Apparently on saturday night he had a few too many and ended up getting in his van and ended up taking out a lamppost. Stupid thing is the place he was at is literally a 5-10minute stagger back home.

Now... he ended up in hospital and was discharged early Sunday morning.

He was not charged at the hospital despite giving a blood sample and presumably being well over. The van was towed and impounded.


Whats the crack here then? I would have presumed they would have either charged him at the hospital or have been around already to charge him.

Odd....

Perhaps the chap ha been released from hospital and wants all references to him having had a skinful deleted.
