@mybrainhurts - how would you go about going "somewhere safe" with a baby a dog and a pushchair? Particularly when one of those items is made specifically for the transportation of one of the others.
The times when I pushed pushchairs is long gone, but I would never have even considered using a lane with no footpath.

Where I grew up the nearest footpath adjacent to a road/lane was around three and a half miles away from our house and only in one direction. To other points of the compass it was even further.

I'm with herewego about consideration. They need educating rather than their selfish behaviour restricting other people's freedom of movement. OP, you have a photo of the bruising. It's probably too late to go to A & E but I would get an appointment to see your GP so there is a medical record.

Then get onto a no-win, no-fee solicitor - car hitting a pedestrian is pretty much a slam-dunk!

Don't bother with the police approach as the criminal courts decide on the basis of "beyond reasonable doubt" whereas Civil courts work on "the balance of probabilities" which is much more easily achievable.

You should get a few quid as compensation, but more importantly the numpty will have a fault claim logged against her for hitting a pedestrian so it will cost her more than any fine and "victim surcharge"!

I grew up in a small village we used to play near roads and water.Playing near a main road into our village with no footpath cost my mate his live he was five.

This was over sixty years ago my mate crossed the road without looking and a car killed him.

In your situation the women should have had the decency to stop and had a word if you was ok.She was problaby scared of the consequenses and drove off blaming you when the police had a word.

People won't own up to their mistakes it is always someone else fault.We live in a compensation culture.

This is not aimed at the OP, but for those defending the right to walk along a road without a pavement and not be hit by cars, I can see your reasoning, but there's no point in legally being in the right and run over.

I stopped riding motorbikes because despite my cautious and defensive riding, I had a few 'SMIDSY's, and one of them very nearly serious, and I decided there was no point ending up 'legally in the right' yet also in a wheelchair...

I have every sympathy though, I grew up in a small village where every road for at least a few miles had no pavement and mostly 60mph single track. I think my mum just avoided the worst of them when out walking with me and my brother.

I assume you didn't read the update about the cow turning up at a later date and her husband threatening the OP.

Personally I'd be dealing with this "Out of court" with baseball bat wink

Same reason I wont cycle on the roads any more.

The OP said he had his dog hit a few months ago and then took a baby in a pram on the same road, (Darwin anyone) yes you might of been ok for the last 10 years but it only takes that one nutter to wipe you out, as its been proved to you.

Hope you get it sorted, this lady does need to be punished.

Just read your posts - that's terrible. I walk down a lane on a regular basis with no footpath and fully understand what you are saying. Its not good enough the police don't give a toss. Hope you get a good resolution to this. Must have been a shock of how close things could have been.

Yes, not impressed with police at all.

What really annoys me is that "speed kills" and there are (weekly) police vans parked up 300 yards from where I was hit. Do 35mph and you are prosecuted etc yet actually hit someone, f**k all happens. Where is the logic ?!?!

I will however be pursuing this further with my MP and the police.

Might as well involve your local councillor as well. They are sometimes very good.

Make sure it gets reported to her insurers. They might have something to say about it next time her policy is due. It's also recorded with them if a similar incident happens again

No you wouldn't.
I've been arrested (and released) for taking a pool cue to sort out a domestic issue.

So yes I would.

If some "big man" threatens my wife then they're going to be sorry, very sorry.

In my neck of the woods we had a set of walkers knocked over by a young lad in a car outside our front door. He took out three of them all in their sixties.

Ambulance and police turned up. We took their dog for three days while they were in hospital, came out with bruises all over them but no breaks.

We heard that the police did nothing with the driver as he was dazzled by the sun, and the walkers were on the road.

So .......
With your dog and baby were you on the road or did she mount the pavement?

In my neck of the woods you would have to walk 5 miles to the nearest pavement.

OP persue an injury claim against her via her insurers. OK it's only a bruise but a bit of pain and suffering mental anxiety in fear of your life etc and you should get at least £500. I'm not saying do it for the money specifically (but it might buy you a bottle of champers you can pop in front of her next time she goes past) but what it will do is put it on her record, lose her a couple of years no claims bonus and give her a fault claim she'll have to declare for a few years. If the Police are as useless as you say could you go for a private prosecution? Re: dashcam footage how about telling them if they delete evidence it will be contempt of court - might st them up a bit?

Didn't spot the bit where he mentioned a pavement, and to be honest its pretty vital, so you can roll your eyes all you like. Meanwhile you top off a daft post with the no win no fee ambulance chaser post
