Time limit on parking ticket?
Discussion
Had a parking ticket reminder through the post last week dated 9/3/05 (don't know what happened to the original) for an offence (limited waiting)committed on 29/09/04. It was issued by the police.
Is there a time limit on these things or can they send them on years after?
Thanks
p.s. tried to do a search but it "wasn't available" ?

I've held back Blue eyes for there is to me a grey area that so far I cannot resolve.
You will be aware that "parking offences" are supposed to have been de=criminalised and enforcement passed to the hands of Local Authority. No hearing, just the ticket and if you do not pay monies recovered through County Court as a debt.
Normally if the Police are involved they take cases through the Magistrates Court and if this is the case they have 6 months to lay an information (notice of offence). Summons can follow after any time provided information laid.
So if they issue a ticket, under the old Police regime, if not paid they have up to 6 months, from commission of the offence to convert from ticket to Court procedure and to lay the information and proceed.
Now I do not know if Police can move across to the LA system, issue and then County Court. I don't even know if there is a time limit on County Court proceedings but suspect chasing a debt will be allowed longer than 6 months.
Book a session with CAB Solitor and task his brain.
Sorry not firing on all cyclinders in this one.

PS Mention your town please which may help my digging.

Thanks DVD. I posted on pepipoo and Viper came back with this reply:
"6 months to go into court unless your details were wrong with the DVLA or they had to trace you through leasing company etc"
Gwents finest issued it so it looks as though we're a couple of weeks short of time out: 29/03/05. Sods law!
We've been given an option of pay the fine (£30) or go to court. I don't have the time and we're probably guilty so looks like we'll have to pay. I'm going to leave it to the last minute though so if anybody has more info/ideas please post.
Thanks again DVD.

Had a word with Plod daughter. Apparently it would appear two systems in operation.
Local Authority and Police. If the former get you then its ticket, appeal in 28 days, denied, fine recovered at County Court.
Police, she tells me still sticks one on for yellow lines. 28 days to appeal, not held then into prosecution mode and Court. Limitations of Proceedings applies as stated.
Not sure but if they are still waffing about with the ticket chances are that information hasn't been laid but one cannot be 100% on that as it will be down to office procedures as to whether inf laid on non resolved after 28 days.
The question is did you park illegally?. If so then can only suggest that you consider paying the 30 notes, which if case taken to Court could be the better bargain.Nevertheless have a written dig about non-receipt of original ticket.

DVD,
I've had a thought...
The reminder is dated 09/03/05 and we have 28 days to pay: 06/04/05.
BUT... the 6 months, for laying of papers, expires on 29/03/05 if I'm not mistaken?
So if we wait and send a letter special delivery to arrive on 30/03/05 telling them that it's over the 6 month limit will that work?
Even if they say no we still have a week to pay and can do it by credit card the day before it's due.

Nothing ventured - nothing gained, but:
As I mentioned earlier, after no response to the first ticket sent out how does one know whether they have laid an information in anticipation and in an attempt to save Court time have tried a second reminder.
Max penalty at Court is 1000 notes for breach of Traffic Order.......

Thanks DVD.
We believe that the ticket was stuck to the car (and possibly knicked) and that this is the first reminder, otherwise we'd have received a court date by now.
True, they may have laid papers, but a quick letter asking for details of this (after the time-out date, of course) should clarify the situation.
We'll give it a go anyway.
Thanks again for your advice.
