My wife has just been stopped and booked for going over a pelican crossing on amber.She was in traffic, lights were changing and she carried on. The Police officer agreed she went through on amber(not red), but because someone was waiting to cross, this was dangerous. She pointed out at
25 mph,by the time she hit the break she would have been over the crossing any way. Any comments, should we just pay the fine or go to court?

Not very clear "for guidance", is it?

Go to court.

CPS would be nuts to go forward with this. Where is the evidence an offence has been committed?

Thanks for help.I forgot to say, the plice car was 1 or 2 cars behind her. There were 2 officers in the car.
She was on her own , but is sure the lights were just changing as she went through!

The amber is like the red and mustn't be crossed but safety is an issue and the decision to cross is the driver's. The car behind your wife could have been right on her tail and the officers behind that car wouldn't really be able to see if it was right on top of her or judge the distance. I think a magistrate could be sympathetic if your wife presented her defence well.

Well if a pedestrian was waiting you'd assume they'd still look when the crossing went green anyway.

Also, doing an "emergency" stop isn't exactly safe when there are pedestrians nearby, especially when there was clearly no need to (no accident ensued because of the event)...

Just Plod's being over-keen i assume. I think like everyone you can catch them on a bad day and you get pulled up on technicalities!

I bet if I was Plod, I could fill my day booking drivers within 200m of the station!

Seems to me she could go with the argument that the car behind was so close, she was concerned of causing a pile up.

Seems pretty harsh to me to book her for what she has supposedly done.

Perhaps the bib were below target for the number of bookings that day?

Yes you do but you have to lie. So the plod car was driving aggressively and had made ure missus feel stressed. When they pulled her they started looking down her top and offered to let her off in return for a shag. When she refused they called her a lesbian. The lights were actually on green and this is all a fabrication. If you get a male magistrate then find an excuse for an ajournment and wiat till u get a female

I like the inventiveness (is that a word?!), though I would have to agree to the earlier posts. Go to court and plead your case... lights changed as you were there, you thought that you had passed the point at which you could stop safely, and also maybe question if they could see how close to the line she was if they were a few cars back.

This happened to my missus a few years back, went through an amber, and plods must not have made enought kitty money that night. Pitty I didn't know what I know now, and she wouldnt have just accepted it.

It's a shame that the money doesn't go to the cops....

One of the great advantages of video cameras in police cars is the evidence captured. Secures convictions or prevents mistakes...equally important.
