I would simply request deposit back at this stage. Hang fire on any threats pending how he responds.

I agree, and I think I would be going to his home to ask for it rather than using social media.

Bear in mind he may be distressed, it's possible that his mother has now also died.

But seriously, yes, go round and see him and ask for the money back. If you get any resistance, advise that you'll use Small Claims immediately - don't let him fob you off with "I'll pay next week/next month" etc.

He is an ex bouncer type bloke - that kind.
Just done some googling and found a review from 2011 from someone saying he dug out his drive after he paid for materials then never showed up again

I bet he is using peoples deposits to finish the last jobs off. Thats why he was still doing the other stuff as he then had your cash. Now is looking for someone else to do some work after yours to get the cash needed to start your job imo

Sorry to hear.

Have you said you would rather cancel and get your money back, what did he say in return?

ive called him twice today no answer.
Il drive over Saturday afternoon and knock his door. I think he clearly uses other peoples deposits to fund his crappy business model

Common business model from my time subbying . Biggest problem facing small firms is lack of cash flow. Keep prices low to get work, and then firms you do jobs for delay payment. Depends on how his credit record is if he can't get materials on credit. Cause - go back a sentence.

Don't escalate too quick OP, ring him, leave a couple of voicemails, couple of text messages - STAY POLITE but clear. Keep record of your communications.

I wouldnt turn up on his doorstep as the first outing, Piss him off too much & you will never see or hear from him again.

I would turn up, no need to piss him off, hopefully can be a civil conversation and looking someone in the eye/body language can divulge the truth better than digital communication.

OP - can your mate tell you or can you find out where he buys his materials? Ring them up and say are you the people that supply Joe Bloggs as he's asked me to order him some materials for my job that he's starting on Friday. His Dad has just died and he's too busy with arrangements so can you deliver xxx materials to my address on his account please?

In the real world see what text evidence you can get regarding your deposit or you will struggle with a ccj.

Then you don't pay the remainder.

At which point you said: 'Don't bother mate. This is the 5th/6th/7th time I've been told work is due to start on a certain date with various excuses along the way. Please tell the other bloke to refund my deposit within the next 3 working days and we'll just draw a line under this. Thanks.'

Forget the social media bks. I would take a trip to his front door and politely ask for your deposit back.

He took your money, now he's taking the piss.

The job is finished before it's even started as far as i'd be concerned.

OP - I see your future.

It involves lots of posts on PH about how you don't have a drive you can use as it has been 'dug out' and that the contractor is refusing to do anything further until you stump up 75% of the outstanding balance of his quote.

After much sole searching and PH replies about who he is, where he lives and what he had for dinner last month you will decide that it is best to make the most of a bad deal and either a) pay him and never see him again b) get another in to finish the job.
