Hang on further update! Now just got a phone call off some other bloke saying he will be over 9am to dig out.

Im in 2 minds now. Do i let him dig it up? - Least ive got some work out of him and if need be pay someone else to complete it. Anyway if there is no show tomorrow then il call him and tell him to forget the whole fking lot.

I just called my mate who had his drive done and he said i dont think he is out to rip you off but he is very disorganised. hmm
I said the bloke is coming to dig it up (rob his name is) and my mate said oh ye rob is the bloke with the digger.
It's like a comedy show.

If he doesnt show today then im telling him to forget it. Is this a police matter if he doesnt want to return my money? He hasnt delivered anything to site and hasnt done any work.

I found this on an American site so not sure if this applies..

If a contractor takes a down payment and does nothing for the job such as having materials delivered or showing up to work on it he is guilty of fraud in most cases. Call the police and district attorney to see what charges can be filed against him.

Once he does even the slightest bit of work or even had materials delivered to the jobsite after taking the down payment the issue becomes a civil matter, in which you will have to get an attorney involved. You'll have to file a suit for breach of contract.

I dare say when i ask for my money back he will say he cant as he has bought the blocks with them - when i ask for proof of this then he might either go and buy the blocks that day, forge an invoice or just ignore me.

I am able and now il have to do it myself and take time off work. Id rather do it myself after this. Though hopefully I can get this deposit back

I texted local BBC radiio station earlier - they read it out and then phoned some bloke off The Sheriffs are coming and asked him about my situation!!!
He said small claims etc

What do you think is this blokes motive? Ive just had a text off him saying he is on his way now with digger & whacker to drop it off use in the morning. Why would you drop plant machinery off and leave it? I havent bothered to respond as there really is no point. Anyway needless to say nobody has turned up. I think he wants to string this out for months, I guess so I dont come looking for him, as right now he hasnt technically pissed off with my money.
Il be driving over to his house AM. This has to be the biggest farce ever.

Well fk me. HSS hire truck outside my fking house with a digger on the back! The driver rang the bell and said 'are you ok mate'? I said I am actually speechless to see you.
He has just driven a digger onto the lawn. I asked him if he did much work for this joker and he said he does a fair bit.

yes he has given me the key to it, looks pretty new. Said it had 90 hours on it. Dont think il take it for a spin.

Digging now underway though they have stopped for fag break at the mo. He rang the bell and said 'alright mate can you move your car'.

I just said sorry to hear about your dad and he said cheers.
Anyway we are now dug out and awiting grab lorry.
stone to be delivered tomorrow AM and whacked down though I am out all day so hopefully all will be well. Blocks arriving Tue
