The issue is one of degree, as usual this normally depends on how much money's at stake. The bigger the sum the more likely a scapegoat will be unearthed by those with the deepest pockets.

If a company's driver was injured but happened to casually remark " he often drove without his seat belt, like other company personnel or other information turned up that showed a casual attitude; then life could be sticky for company and management . Ironically, if the driver died then the risk to the company 'might' be less if the training manuals could be revealed.

I don't think he quite understands that although H&S can be stupid, the law is the law.
There's a difference between "H&S" being stupid, and your employer's H&S person being stupid.

This is very true. I believe there needs to be a risk assessment for the kettle, but the only person who needs to sign it is the person writing the risk assessment.

I always dread the word 'risk assessment' - but there are so many generic documents out there, they're really not a worry to me anymore.

I too dread the 'risk assessment' in the very few factories I visit that ask for one.

" How are you going to repair our machine"," I've no idea, what exactly is wrong with it ?", "we don't know that's why we called you", "well I don't know either, shall we go and look at it ?"

It is this kind of crap that leads me to dislike H&S , along with "you can't possibly work on it with the guards removed" & "we don't allow any work in electrical cabinets with the power turned on ".

I realise it won't be all H&S people, but you only remember the tts, and on occasions those tts cost their company a few thousands of pounds with this stupidity.

You should not need a drivers handbook that tells you to wear a seatbelt, it is the law that you wear a seatbelt.
You should not need a drivers handbook to tell you not to speed, not to drink drive, not to use a phone unlawfully etc etc etc

As "your" employer it isn't ( i hope) my responsibility to ensure you live your life within the law, you're a big boy now !

Under current legislation it IS your responsibility to ensure your employees have advice on how to work within the rules that exist. That does include driving and machine operation. Failure to do so is negligence on the employer's part and could leave the company and the individual responsible for H&S open to criminal charges. Do you really want to run the risk?
