There is no legal obligation to identify the driver - it's only an invoice, not a statutory S172 request from the police or local authorities.

It is then up to them to comply with POFA 2012 to hold the keeper liable, and those that do are few and far between. It's generally easier to challenge on failure to comply with POFA than it is to argue over signage, landowner authority etc.

Then they will try and argue bullst and bamboozle you with Elliott v Loake, which is just plain daft on their behalf

BW Legal tried that with me in a claim, but it was dropped after I submitted my defence.

Which is a shame, as I was very curious to know what forensic evidence they had to place a Ltd company at the scene of the incident.
