Okay, but what about the warehouse staff, etc., who you said all could have been driving the vehicle? How were they eliminated from this inquiry, given the lack of any record-keeping system in place at the time?

If the evidence you've finally been given satisfies you enough to accept that you were driving at an "out-of-character" excessive speed in the middle lane, then so be it.

Yes. Which is why I asked how long he has to reply. If possible then the reply should be posted by Signed For mail to arrive after the deadline to institute proceedings.

The warehouse staff etc. were all also discounted due to their clocking out time or the fact they were logged on to computers or our voice system, forgot to mention that, it really was a very conclusive list.

As for the outcome not being what I wanted, well it kind of is. Obviously I would have preferred it if I wasn't the driver but I believe that this has made them take notice of their record keeping and the rather cocky manager has had a bking. I've done what I felt was right.

NIP says 28 days from the date of the letter, which is the 20th of Dec.

At least it's resolved OP before Christmas.

Is it being suggested that if you can avoid admitting who the driver is for 6 months, (as long as you reply to each NIP within the timescales), that there can be no prosecution?

I'm surprised the six months in this case has gone by so "quickly". Somebody wasn't keeping their eye on the ball, and gave the OP and his company too much time to respond...

I think one of the issues it's taken so long is because the van may be a long term rental so any paperwork has to go through the owner, then the company then to me.

It’s almost 2 weeks since he was told that the time is almost up anyway.
