Fair play on going after the original sellers I can see why you picked the option, your retired so it is basically entertainment and hopefully they learn their lesson. Really hope they have to cough up as the deserve.

Thanks you have seen it as to what it is, The sellers really need to be taught a lesson they have been around the area for years winding up businesses they have started and taking good local people for there hard earned.

My solicitor is advising this will not happen as they have assets, they are also directors of various local businesses and i have the option of if I believe it will go down the monthly repayment route i can pull the plug and refer back to solicitors insurance

Thanks guys for all the advice and its all aimed in the same direction, I may have to have a rethink on things my gut Is to make the sellers suffer but i would like to recoup my £10k and the way i see it the solicitors or the insurance company is going to pay up, Or maybe even the council as i,m confident i have them on the ropes concerning not pursuing the original sellers to cough up, I had a experience 8 years ago for which i,m still paying for as until i recently retired i run and owned a successful company in the construction industry where a scrote had a injury caused by his own work ethic, He went on to a no win no fee company and it took 5 years and well in excess of £100k of my insurers money for him to back out on a claim just before it went to court my premiums went through the roof as we were then known as a high risk company, Will keep the thread updated....

I wrote to my solicitor early this morning reminding them that our agreement was open for review before they issue proceedings and i would like at this time to review the possible outcome,
I did make it clear in my decision to let them chase for the money that i was 100% not interested in reclaiming my money by any instalment plan,
Could be coincidence but I’ve heard nowt back.....

This just in,
The sellers have offered through there solicitor to repay the debt to us at £1000 per month with the first instalment paid immediately, Decision time .....

I deal with issues like this on contracts and real estate much of the time, and the key learning is don't let people off the hook, especially when they have insurance that will cover their cockup.

I am concerned they are trying to take advantage of your good nature - as you can probably tell from my posting style at times, winning in property often means that you don't apply a good nature even when its not your usual style.

In short - play hardball

My solicitor has now emailed to say they have referred it back to there insurance company.

WELL HERES A UPDATE,
Our super dooper helpfull solicitor ...yawn....Has today agreed to pay us the £10k back and pursue the previous owners themselves, I would like to say to everyone who has helped and offered advice a real big thank you, you guys are a credit to PH and again thanks very very much,

They decided not to go through there insurance but pay it themselves ????

A amount on top wouldn’t be turned down but for me i,m happy to get my £10k returned,
It’s not quite over for me as i,m awaiting a reply from the council with some answers,amongst other questions i have asked,
Why or who made the decision that the previous owners who signed the agreement and after all this was bought to light agreed to repay the council were allowed to walk away and we were forced into having to pay the debt, They don’t know that i know the answer to this question and there constantly avoiding answering it........
