Part of the declaration for an ESTA is "Have you ever violated any law related to possessing, using, or distributing illegal drugs?". Doesn't ask if 'convicted', only violated. If you tick yes to this then you need a visa. Whether one would get a visa is questionable, and if one did whether one would be let in at the immigration desk is also questionable.
I have a bit of a record, ticked "no" and they didn't even look at me.
I was there for work and wearing a suit though, might have made a difference.
Before I had the rap sheet I tried to get into Canada, though - and a years old drink driving offence that they found somehow, had them turn me away.
An hour with Customs, still no go - next flight back, they said. Was dressed casually that time (jeans and T-shirt), maybe that made the BAD difference. Was flying in to meet a client in Niagara Falls, so just rearranged the flight to Buffalo, the US side, Let the client know (about an hour's drive more) and did my job. Boss wasn't happy about the extra expenses, but happy that we won the contract!
Buffalo is rubbish, BTW.

As I understand it - looked into this for a work colleague once - the ESTA system has no routine access to the UK criminal records system.

9/10 or higher if our OP ticked no (assuming he had received a caution) to the question re have you ever been arrested for drugs he would have been fine anyway. They can on point of entry dig further into the system if they don’t like the look of you or for other reasons.

That’s not advice by the way - just saying that unless you’re a high profile criminal (flagged on the system) you are unlikely to be pulled up for not declaring a caution for 0.3g of coke on your ESTA. But it could happen and then you’d be in trouble!

I’m still amazed the bouncer called the Police for such a tiny amount anyway - what a crap club! At the very most I’d have expected being asked to leave. I suspect it’s because of it being in separate little capsules - very odd way of going about things.....

Why hopefully? What would you like to have seen happen in this situation?
Wouldn't bother interacting with him, every post he makes is sour, bitter or negative. Some times just simply insulting. Better off pretending he doesn't exist.

You come across as a sad nasty little . Is this an intentional trolling technique, or a sad window to your soul?

OP, IMHO you are a knob! As for the others on here who condone taking this drug you are also Knobs.

If it were up to me anyone obtaining/using Class A drugs should be prosecuted. You are all losers!

I have never taken any Illegal drugs in my life and don't intend to do so, only because I know I would like them.

Yes, I drink (probably too much) but illegal drugs, Never, not even a spliff. There is much more in life to give you a high than Drugs.

Naïve? Probably. Just MHO.

things that are ok to put in your mouth:

food
(but be careful, chocolate is psychoactive)
oh, so is alcohol
and caffeine
cocks
morphine

thing's that are not?

heroin
cocaine
etc.etc.

---

makes total sense to me.

what people knowingly and deliberately ingest, inhale or inject is their own business. not the government's.

btw, morphine and heroin are two carbon atoms and six hydrogen atoms apart

Irrespective of my personal view on illegal drugs. (Not relevant to this discussion)
The outcome seems sensible and one I would have endorsed had I been a Police supervisor in this case.

My advice though would be not to get involved in what is currently an illegal activity. (The same applies to any illegal activity)
If you get caught again for drugs the range of disposals will be more limited, and the detrimental impact on you likely to increase.

Like alcohol? Is this post intentionally ironic? (Genuinely not sure if serious).

The 'problem; is that if you make no ocmment you make force the Police to prosecute because you cannot be given a caution if you dont admit the offence

So it depends on what you want to achieve and what evidence there is..

In this circumstance, perhaps, although there may have been that little cocaine in the capsules that it was under their prosecution threshold. My point here is that whilst I suspect that you are correct, his acting as he did may not have been the reason.

I dint think that solicitors and police officers will ever agree on what you should do and I would tend to take a solicitors advice on this subject.
