Scammed by a Hacked email account

I'm not sure knowing if it came from their account would help?
Some comparable situations where I doubt it would be ruled that the builder is liable for the loss of the money:
- Builder threw out a copy of the invoice with the OPs details. Scammer finds the invoice and writes a letter to the OP "from" the builder asking for the money to be paid in a different account.
- OP goes to builder's house with cash to pay the invoice. Somebody unknown answers the door and says the builder is out but he's his brother and will take the money. It turns out the person was a burglar, the builder left the back door unlocked. (A closer scenario would be that person claims to actually be the builder, and in poor light the OP didn't recognise it wasn't them)
