I'm quite surprised at the verdict, I'd expected NG. Goes to prove the unpredictability of the judicial process. Was your solicitor legal aid?

Sounds to me like you were very badly let down by your solicitors. Complaint to senior partner. They should fund the appeal!

Hence why I said many many pages ago that it was a risk putting your faith in the hands of our judicial system when a simple apology right from the outset would have settled the matter.

Principles are there to be reconsidered when common sense suggests the circumstances seem right to do so.

milkround, I wasn't sure at the beginning of the thread, but you have shown yourself to be a good chap; and very open and honest about yourself, plus willing to learn. Commiserations about the loss today. While it must be tempting to fight on, it must be very alluring to close things off and move on.

For what it's worth, I used self service checkouts twice today, and both times obtained/took a receipt with a nod to this thread!

Many aspects of it I was unhappy with. The solicitor who turned up had only been given the case the night before. She got stuck in traffic so was 2 and a half hours late. She hadn't been given a copy of my partners statement. She didn't have the CCTV so I needed to show it on my laptop. In the end she had to ask the CPS to use their CCTV throughout. Even ended up asking me if there was anything that had been missed when she was cross examining the guy who I'm now guilty of attacking. Felt like she did her best - but it all just went to rubbish. The mags got annoyed at the lateness, especially when she asked for an early lunch so she could go over the stuff.

So... I have to think about where I go from here. I lost and I have to accept that. Tbh after today I'm inclined to just pay the money and move on. It wasn't exactly a nice experience. All the CCTV which I had enhanced had not been served on the CPS so couldn't be used. Ultimately I lost and no one else.

Sorry to those who did believe in me a bit. I was gung ho about appealing a loss but really need to think about this.

If it makes you feel any better MR, it cost me more than that (inc barrister fees) for a traffic offence a few years back.

Hard luck on the judgement, you made your decision and stuck by it and good on you for that. Hindsight is 20/20 and all that.

And V1nce fox owes a fiver to charity too!

Sounds a bit st I don’t think you should be found guilty of assault unless it’s clearly been proven. All the weirdness with the cctv is well out of order and I say that impartially with no axe to grind either way.

You should be fine with no receipt as long as you answer the security guards questions with a smile on your face smile

Trouble is, the security guard is now in the clear to continue his behaviour.

I'd be complaining to the solicitors about this. Sound like they stitched you up good and proper.

i only ever thought it was going this way.

As much as you might be innocent, the fact the SG had no charges meant that it was going this way. Sad for you but an example on when to fight and when to admit defeat and move on.

Well unless the security guard pushes you etc then what? Anyone could end up in this situation from an ordinary event, you never know.

Sounds like you got a poor solicitor, but perhaps that was what you were paying for? Unfortunately it appears that justice isn't cheap.

Crowdfund an appeal. I will put £100 in.

Did your solicitor cross examine the SG properly?
Did your solicitor say in any shape or form that you were being attacked and recite the law
regarding arrest under PACE sec 24b?

Can you give more detail as to where you think it went wrong and what the magistrates said at the end of the case.

Are you going to appeal?
