Gearbox / Dealer issue

Going to keep it simple and some advice if possible please-

New manual car purchased

Gearbox was not brilliant out of the box , selecting gears is not great at lower speed and reverse can be a pig. Almost feels like the clutch is not disengaging.

Advised to let it all bed in which I was happy to do.

Still not great after 2k miles so when passing the dealer one day dropped in and one of the mechys went for a spin, he agreed and advised we need to book in for a week as the box will probably have to come out.

Car goes in and I am now being told it’s a how they all are and that’s it.

So we have gone from the master tech saying the box has got to come out to it’s fine just put up with it!

Thoughts please?

I would have thought that as a new car with less than 2k miles on it & there is a problem you might be in a position to reject the car.

If they're so convinced they all do it, get them to lend you another one of the same mechanical configuration. If they will not, you have your answer - they don't all do that. If they do, and it does it, it's a possibility.

Obviously difficulty arises if this is a piece of exotica that they won't have a similar one of.

exaclty this. test drive another one and compare.

The sales manager has an identical car that they are happy for me to drive and feel.

So I am not doubting them, but my point is if their master tech felt the box was faulty why should I put up with it?

because 'felt' is not 'removed and stripped box, identified worn/damaged/misaligned part'

The issue of wether 'they all do it' is not relevent because you raised a concern about the suitabilty of the car early on shortly after purchase with the seller.

From that point on at the request of the seller you allowed (quite rightly) an analysis to take place by using their experts (not your own) who remarked that there was indeed a question over the operation of that gearbox. To such an extent it would require removal.

A conclusion was then reached by the seller that in fact all the models had that defect.

As you raised your concern about the gearbox early on, that is the point that counts, just because all the cars have that defect does not mean you cannot expect redress.

If other people wish to drive around in cars with defective gearboxes that's their choice.

You've got a long way to go before you get to defect.

So far you've got to 'I dont like the way the gearchange feels' and they've got to 'there's nothing wrong with it'.

Although consumer law is weighted in favour of a consumer with respect to pre-existing defects at point of sale, and liability for repair, the onus remains with a claimant to establish that a defect is present.

If you still believe tha car is defective and the seller says there's nothing wrong with it, the next stage is probably to get it independently tested by somebody credible whose opinion would stand up in court.

This is pretty much how I see it,

Gonna give them a call tomorrow and try and get this sorted.

Why did you purchase it if you never liked how the gears felt?
Genuine question, before buying a new car I'm sure a test drive was done; was the tester not the same?

No manual available to test anywhere at the time and just assumed spending £30k on a car would mean you are able to change gear easily.

Its not just a case of I don't like how it changes gear its a nightmare!

My Mrs *really struggles to get it into first, second etc....

Not a Volvo buy any chance is it?

The ones i've driven have been pretty tight in 1st-2nd.

Is it better if you double clutch?

It is indeed, something I was used to when working with tractors built in 1970 but not in our 2019 car!

When I reported the fault I told as this to the dealer but they don't seem interested in my thoughts.

I am not going to comment on the make etc.... as I don't want to go down that route yet.

Lets just say its not a bargain basement Chinese manufacturer!

Have it done the most basic first check and looked at the fluid level?
