Main dealer has written car off

Have been watching this tread.
Surely if the money is coming direct from the dealer. Its not come from insurance as would they have had a payout so quickly and would the spiciltor not be in charge of the money if they worked for the insurance company ?. So they have lied about what has happened.
OP make sure the car does not appear for sale. As I remember seeing a post about MB dealer selling a car that had been repaired after serous damage.

this whole story makes my blood boil. I would do everything i could to end the shameful practice of the dealer. I'm assuming they've been named on here already, if not please let us all know who to avoid in the future.
One option is to riase a fund raiser to get a solicitor on the case, i for one would be quite happy to bung a £20 at a case like this

I was wondering if charging the OP's sister for a service on a vehicle they no longer own or had benefit from before the vehicle was crashed could be fraud. It would seem to tick the dishonesty box.
Whether the service was done makes no difference to the trade value that the dealer is paying out, but may benefit the dealer if they repair the car and sell it.
The conduct of the dealer reminds me of the dishonesty tests in criminal law, with the Ivey test for dishonesty replacing the Ghosh test. The conduct of the dealer does seem somewhat off.

As this has gone uncorrected I'll mention it's not MB apparently - check the picture round a few posts back I may have missed this earlier as I haven't read the whole thread. Surely you take the dealer to court for the money to the value of a replacement car. It's up to him to claim it off his insurance, that's nothing to do with you or your claim.
It seems a pretty straightforward case if he has a similar spec car up at a certain value, that's what you claim. How could he argue otherwise?

If every one of us were to ask them to justify their stance by questioning them on their public facing social media pages.......
