I agree, I think it's real, and they've assumed your land is public land/road.

Although this one has clearly been issued in error, I am glad the the DVLA are taking such a hard stance on untaxed vehicles.

Hi,

Yes, it's my land. A strip between my house and pavement. It's clearly within my boundary on the deeds.
If it's demonstrably your land, maintained by you and not out of the public purse, then I suspect it could simply be a mistake by a DVLA enforcement drone.

I'd write back advising them of the above, including any supporting evidence which is easily to hand.

That space looks quite narrow from the photo, so is it a motorbike, or a very narrow vehicle?

Were you FULLY inside your boundary or was a mirror/wing/wheel over the boundary?

If the car was straddling the OP's property and the footpath would that be illegal?

Motorbike wouldn't be £360/year road tax

Hi,

The picture from Streetview is a bit distorted. The width is approx 2.5m and the vehicle is fully within the boundary.

The letter was received a couple of weeks ago. I have written back with photos and a copy of the land registry document showing boundary.

Tried ringing but every option pretty much ends up saying you have been caught with an untaxed vehicle and any appeal will be unsuccessful.

What normally happens is that a camera vehicle drives around looking for untaxed vehicles and if the numberplate pings the system then a "fine" is sent out. Of course, the camera cannot distinguish between private and public property. NSL/Marstons seem to be the biggest operator for DVLA of camera fleets.

Easiest way to resolve this in future is to remove the number plates or screw them on back to front so you don't lose them.

Or just cover them up? Would be a lot less hassle than screwing/unscrewing

OP, is the vehicle a slightly mouldy VW bus, and has one of your neighbours been giving you the stinkeye for the last few weeks?

I think I will remove plates if it stays much longer.

It's not a VW and was in use 12 months ago so not guilty of that one smile

So have received this letter in reply and there is going to be no further action.

I still don't like the way the letter is worded and I would really like to know what further action would have involved, if the enforcement officer hadn't
graciously decided not to take any.

Its pretty standard wording, I had similar after a dispute

A standard NFA letter, they can never actually bring themselves to just say "sorry our mistake"

The original DVSA letter was sent on 7th June. I assume the OP then contacted them and they've sent out the "penalty waived" letter last Tuesday (22nd). OP then posted about the incident two days ago and received the 2nd letter today......

I didn't post on here straight away. I had already sent the letter back with my defence on 13th June. Still reasonable for anything DVLA and Royal Mail related though I guess.
