I would think the fact that the other driver kept to his lane, and you had to enter his lane to proceed, trumps any uphill bit.

Unless I'm missing something, I think it depends on how big the gaps between the obstructions were and how easy it would have been for either of the cars to move sideways into them. Otherwise none of us would get anywhere in built up areas.
You missed the bit where the OP came upon the parked vehicles, saw the 38mph car approaching and STILL decided to pass them,on the wrong side of the road might I add

Not 2 buses, especially if one is doing 38mph wink

Fair point. But I've read again and think that the key bit I missed was that the other car had to slow down "quite a bit". All I was getting at was that often it's a matter of judgement whether the parked car obstruction is a continuous line or a series of separate obstructions.

Either way, having read again I agree that the poster was at fault. smile

Me too.
I do a lot of miles I'm a pretty good judge of speed
Just not of your own driving.

IF you were that good at judging speed, you would have got to the gap you were aiming for without forcing the other car to brake!

Not only are you an expert judge of speed, you can tell two strangers occupations by forcing them to brake while you are on their side of the road. Outstanding!

Shame you weren't observant enough to notice the hazard central road markings that you were certain weren't there.

May have misunderstood, but if the cars are parked in your lane, what makes you think you have “right of way”?

Chris
I don't think they were parked in my lane exactly

It's a village so it's just cars parked against the curb, no road markings

So, looking at that pic, you had to go over the median to continue.

What makes you think you had the right of way when you would clearly be on the other side of the road?

Highway Code

Don’t know about this case, obviously, but I can see how someone going uphill might think they have priority, all else being equal.
The full rule is:

HC said:
Rule 155
Single-track roads. These are only wide enough for one vehicle. They may have special passing places. If you see a vehicle coming towards you, or the driver behind wants to overtake, pull into a passing place on your left, or wait opposite a passing place on your right. Give way to road users coming uphill whenever you can. If necessary, reverse until you reach a passing place to let the other vehicle pass. Slow down when passing pedestrians, cyclists and horse riders.
Not sure it’s applicable to a “normal” road. When I learnt, giving priority to vehicles coming uphill was encouraged although I’d always assumed this was because in the old days cars were underpowered and might require a “run up” to get up hills. Don’t think that’s such an issue now.

Chris
That's what I figured cheers

I think the uphill bit trumps the side the obstruction is on bit.
It's not a single track road - so the rest is moot.

On what planet does you going uphill make the slightest difference?

Traffic was on your side therefore you should have given way. The rest is irrelevant, road captain.

Technically incorrect, but who was more to blame, you or the BMW driver?
I empathise with the speed thing. In that situation I try to decide if I will reach the end of the line of parked cars before the oncoming car. That's more a judgement of distance than speed. If I'm doing the maximum I'm allowed (i.e. 30 in a 30 limit) then if I'm closer to the end of the line than the oncoming car is, then I should be able to make it.

If the parked traffic was on your side, then perhaps you should have slowed.
Then again, if you were going up uphill, perhaps the BMW should have let you through - he sounds a bit shouty, angry and unpleasant.

Maybe 6 of 1, half a dozen of the other?

Either way, no harm done, no one died, the world continues to revolve around the sun etc etc

Bit of a mountain / molehill . One for the Jeremy Vine Show on R2 perhaps :
