Have received a NIP for doing 65 in a 40 by mobile scamara van.

Does a NIP mean court case? or is this typically a FPN?

how many points likely?

Under ACPO Guidelines you should receive a Conditional Offer to pay £60 and have 3 points on your Licence.
At 1 mph more then Court.

Under New Penalties in the Road Safety Bill before Parliament, when it gets Royal assent then you would be down for a Higher Penalty of £100 and 6 points.

If you go to court then the Scameraship doesn't get your cash.

So they'd rather just give you the conditional offer and be done with it. If it was about safety, for 65 in a 40 you'd be heading to court...

I would have thought that if the NIP has been issued and if a conditional offer was being made I would have thought it would have been with it.

If you get the chance, I would snap their hands off as the penalty would be highly likely to be more when the magistrates decide.

You didnt say whether you were going that speed. If you *were* choose your position carefully. My advice would be to go down the method with the least penalty.

If you are sure you *werent* then there are ways forward to fight the accusation, but it may be a long process, and would depend on whether you can afford to finance it and risk losing more.

There is no conditional offer stated in the NIB however it does say "in certain circumstances it may be decided not to prosecute but to offer a fixed penalty procedures"

to add to confusion it also has a fixed penalty reference number which suggests to me a fixed penalty will be issued once i send back the paperwork.
