A discussion at work prompted this. Someone said that for £2.50 you can get the name and address of a car owner from their registration plate, via the DVLA.

Is this actually true? I know there was the story of the cowboy clampers doing it but what is the extent of this "loophole"?

Apparently 'security' firms can do this. There was an article in the Sunday Times about it this weekend. Sainsburys use it to send fines out to anyone who parks in their car parks for more than two hours.

It's an outrageous selling out of privacy in my opinion. I really don't know on what basis this right was granted to the DVLA.

Apparently so, its criminal if you ask me but then so is the unregulated nature of clampers.

According to that article

The DVLA made £2.75m from these requests in the 2005-2006 financial year.

Does the 'Bill of Rights' defence remove these threats?
No Fine or Forfeiture shall be valid unless a court has found an individual guilty. That seems to cover it nicely. They may be 'demanding money with threats and menaces'! Threaten them back.

I wouldn't worry about your personal details are traded by this government around the world. DVLA records to crinimal clampers, credit card details given to US everytime you go and see disney and they have now announced that once they bag and tag you under the ID scheme your biometrics will also be openly traded.

Be afraid - very afraid.

Basically you have to tell them that you intend to issue legal procedings so need the driver details. Whether you issue the proceedings is another matter which could be a cause for concern.

Presuming this information is kept on a computer, can't we all issue s.10 notices (s.10 of the Data Protection Act gives a right to prevent processing of information likely to cause damage or distress) and stop this from happening?

Be interesting to see the DVLA processing 60 million S.10 Notices.

Had some guy park on my drive, blocking me in. Totally on my drive, preventing me from leaving.

DVLA would not release details.

Cops would not remove vehicle as on private property.

Was warned that they now had a record of my intention to remove the vehicle and that I would be held responsible for any damage that occurred!

3 days later owner removed it of his own accord while I was at work.

If a similar thing happens again write to them saying you wish to instigate legal proceedings (civil) against the driver of said vehicle. Request the address and assure them it will only be used in connection with legal proceedings. You don't have to say what the matter is about.

This is currently undergoing a ministerial review following the Times article mentioned above.
I'm fairly certain that the DVLA are not sending out these details any more, pending the results of the review.
This is certainly the case at work as we're trying to get these details (for purely legal reasons, honest guv) and despite having signed a contract with them before this all kicked off, they're dragging their heels about giving us access

Notice Persuant to S.10 Data Protection Act 1998

Take Notice that I require you to cease processing any personal data of which I am the subject insofar as the processing of that data involves the communication or passing of personal data to any third party.

This Notice is given onthe grounds that the processing or continued processing by you of the said data will be likely to affect my reputation and cause substantial damage and /or substantial distress and is unwarranted.
