It's come to my attention that the local authority has had to decommission 2 parking meters because the signage at the parking bay is apparantly incorrect. Now, the markings haven't changed for years so by my reckoning they've been coining it in via fixed penalties for 5-10 years!

I want them issue refunds to motorists who were rigorously forced to pay up. I've written to the council but been ignored thus far. What's the best way to shove it up them?

Get something into the local press publicising the matter.

You need someone who was fined to take the matter up as you have no case yourself if not fined. The payment of a "fine" that was incorrectly claimed is a payment made as a mistake of law. There is a time limit of 6 years to make the claim to recover your funds, which begins when the person knows, or reasonably should have known, that the mistake had occurred. Interest is also due on the amount from date of payment to the date of refund.

HoL is currently considering "Morgan Grenfell" which concerns whether Government is protected from returning cash "stolen" by way of mistake of law.

You need to get the press involved. Then everyone who has been incorrectly fined will need to contact the council for a refund. They won't proactively return the money.

Very interesting FiF. I know another parking place where the double yellows cross an alleyway as a single dotted line. Been like that for years and they still keep issuing tickets.
