On original incident.....

Almost certainly car drivers fault unless excessive speed (sounds like not) was involved as they should have looked before manouevering.

PS I'm a car driver and motorcyclist and have learned to be more careful when swapping lanes having almost caused a similar incident in the past - shame others don't seem to learn from their mistakes

Sadly, its one of those 50-50 knocks as both must share some of the blame.

Car Driver for not taking enough care when carrying out a manouvre, and Bike rider for the same.

You sure TR?

This guy has changed lanes into a filtering bike without looking.

A similar example came up on my bikesafe course and it was the driver fault.

It would need a look at the scene, speeds of vehicles, any witnesses etc.
Just on the info given, this is a classic knock for knock (Ins talk) and one which i certainly dont want to be involved in.

IF the motorbike was travelling more than a 'sensible' speed past the slow moving traffic, the bike is at fault. IMHO

If it was travelling at a reasonable speed, then car is at fault. IMHO

BTW: It would be great if all the motorcyclists can wave thanks when I move to one side to give them more space in slow traffic. Just a thanks would be great...

In France when I have moved over for a biker, they never wave. They just shake their leg at you. Brill.

I've laid a VERY large darkie on both road and underpants in a similar situation (on a motorbike). Big shiny new Merc with Big shiny man inside pulled from 3rd to middle lane as I was filtering in 10mph traffic and approaching his rear wing...

Avoided the collision, so thought I'd have a word with him as the traffic next slowed to halt. He was very apologetic about his manouvre and admitted that he'd not looked before moving. Think he'd of been apologising if I'd hit him? No way. If we'd hit it would have been completely my fault.
